                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for antique and classic motor
     3     vehicles; and providing for collector motor vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The definitions of "antique motor vehicle" and
     7  "classic motor vehicle" in section 102 of Title 75 of the
     8  Pennsylvania Consolidated Statutes are amended and the section
     9  is amended by adding a definition to read:
    10  § 102.  Definitions.
    11     Subject to additional definitions contained in subsequent
    12  provisions of this title which are applicable to specific
    13  provisions of this title, the following words and phrases when
    14  used in this title shall have, unless the context clearly
    15  indicates otherwise, the meanings given to them in this section:

     1     "Antique motor vehicle."  A motor vehicle, but not a
     2  reproduction thereof, manufactured more than 25 years prior to
     3  the current year which has been maintained in or restored to a
     4  condition which is substantially in conformance with
     5  manufacturer specifications and appearance.

     7     "Classic motor vehicle."  A [self-propelled] motor vehicle,
     8  but not a reproduction thereof, [manufactured more than ten
     9  years prior to the current year and, because of discontinued
    10  production and limited availability, determined by the
    11  department to be a model or make of significant value to
    12  collectors or exhibitors and] which is included on the list of
    13  milestone or classic cars published by the Milestone Car Society
    14  or the Classic Car Club of America and has been maintained in or
    15  restored to a condition which is substantially in conformity
    16  with manufacturer specifications and appearance. Any classic
    17  motor vehicle registered under section 1340 (relating to antique
    18  and classic plates) which no longer qualifies as a classic motor
    19  vehicle under these provisions may retain a classic registration
    20  as of the effective date of this act unless another type of
    21  registration is applied for and issued for the vehicle.
    22     "Collector motor vehicle."  A motor vehicle, but not a
    23  reproduction thereof, manufactured more than ten years prior to
    24  the current year, which has been maintained in or restored to a
    25  condition which is substantially in conformity with manufacturer
    26  specifications and appearance.

    28     Section 2.  Section 1340 of Title 75 is amended to read:
    29  § 1340.  Antique and classic plates.
    30     (a)  General rule.--Upon submission by a vehicle owner of

     1  information satisfactory to the department that a motor vehicle
     2  is an antique motor vehicle or classic motor vehicle,
     3  accompanied by the appropriate initial registration fee, the      <--
     4  department may issue a special [plates] plate for the vehicle.
     5  [No annual registration fee may be charged for antique or         <--
     6  classic motor vehicles.]                                          <--
     7     (b)  Use of plates.--It is unlawful for any person to operate
     8  a vehicle with antique or classic registration plates for
     9  general daily transportation. Permitted use shall be limited to
    10  participation in club activities, exhibits, tours, parades,
    11  occasional transportation and similar uses. Occasional
    12  transportation shall mean no more than one day per week.
    13     Section 3.  Title 75 is amended by adding a section to read:
    14  § 1348.  Collector plate.
    15     Upon submission by a vehicle owner of information
    16  satisfactory to the department that a motor vehicle is a
    17  collector motor vehicle, accompanied by the appropriate fee, the
    18  department may issue a special collector plate for the vehicle,
    19  which shall have the same force and effect as a regular
    20  registration plate.
    21     Section 4.  Sections 1923 and 1931 of Title 75 are amended to  <--
    22  read:
    23  § 1923.  Antique and classic vehicles.
    24     The fee for initial annual registration of an antique or
    25  classic motor vehicle shall be $50. The fee to renew the annual
    26  registration of the vehicle shall be $10.
    27  § 1931.  Personal registration plates.
    28     The fee for issuance of a personal registration plate shall
    29  be $20 which shall be in addition to the annual registration
    30  fee. [Only one payment of the issuance fee shall be charged for

     1  each personal registration issued or replaced.] The annual fee
     2  to retain use of the personal registration plate shall be $10
     3  which shall be in addition to the annual registration fee.
     4     Section 5 4.  Title 75 is amended by adding a section to       <--
     5  read:
     6  § 1933.  Collector motor vehicles.
     7     The fee for issuance of a collector motor vehicle plate shall
     8  be $20 which shall be in addition to the annual registration fee
     9  appropriate for the vehicle type. The issuance fee shall be
    10  charged for each collector vehicle registration plate issued or
    11  replaced.
    12     Section 6.  Section 4703(b)(10) of Title 75 is amended to      <--

    14     SECTION 5.  SECTIONS 4303(E) AND 4703(B)(10) OF TITLE 75 ARE   <--
    15  AMENDED TO READ:
    16  § 4303.  GENERAL LIGHTING REQUIREMENTS.

    18     (E)  EQUIPMENT EXEMPTED BY REGULATION.--ANTIQUE AND CLASSIC
    19  MOTOR VEHICLES, ANIMAL-DRAWN VEHICLES, IMPLEMENTS OF HUSBANDRY
    20  AND SPECIAL MOBILE EQUIPMENT, IF OPERATED EXCLUSIVELY BETWEEN
    21  THE HOURS OF SUNRISE AND SUNSET AND NOT DURING PERIODS OF
    22  REDUCED VISIBILITY OR INSUFFICIENT ILLUMINATION, MAY BE EXEMPTED
    23  FROM CERTAIN LIGHTING EQUIPMENT REQUIREMENTS OF THIS PART BY
    24  REGULATIONS OF THE DEPARTMENT.
    25  § 4703.  Operation of vehicle without official certificate of
    26             inspection.
