AN ACT 1 Amending the act of July 2, 1984 (P.L.527, No.106), entitled "An 2 act providing for the rehabilitation, development and 3 acquisition of land, water and structural resources; defining 4 the powers and duties of certain offices, agencies and 5 municipalities; providing for the allotment of proceeds 6 hereunder including Commonwealth grants; prescribing 7 standards; and making appropriations," providing additional 8 funds to the Department of Community Affairs; and extending 9 the provisions of the law for an additional three years. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Sections 4(a) and 9 of the act of July 2, 1984 13 (P.L.527, No.106), known as the Recreational Improvement and 14 Rehabilitation Act, amended July 9, 1986 (P.L.1213, No.107), are 15 amended to read: 16 Section 4. Appropriation of moneys. 17 (a) Appropriation.--From the moneys received by the 18 Commonwealth from the issuance and sale of bonds and notes
1 pursuant to the act of July 2, 1984 (P.L.512, No.104), known as 2 the Pennsylvania Economic Revitalization Act, there are hereby 3 appropriated as follows: 4 (1) The sum of $19,780,000, or as much thereof as may be 5 necessary, is appropriated from the Pennsylvania Economic 6 Revitalization Fund to the Department of Environmental 7 Resources for the period beginning July 1, 1984, and ending 8 June 30, 1988, for site development and material costs for 9 projects authorized and funded under the act of July 2, 1984 10 (P.L.561, No.112), known as the Pennsylvania Conservation 11 Corps Act. The Secretary of Environmental Resources shall 12 have the power to promulgate such statements of policy, 13 guidelines, rules and regulations as may be necessary to 14 effectuate the programs undertaken, including contracting 15 with persons, firms, partnerships, associations or 16 corporations as may be necessary. The Department of 17 Environmental Resources shall establish procedures for the 18 application and distribution of funds pursuant to this 19 section. Municipalities sponsoring projects authorized and 20 funded under the Pennsylvania Conservation Corps Act shall be 21 eligible to receive funding under this paragraph only for 22 those projects having recreation purposes and then no more 23 than 75% of the cost of development and materials for those 24 projects. All other projects sponsored by municipalities 25 shall be ineligible for funding under this paragraph. 26 (2) The sum of $18,000,000, or as much thereof as may be 27 necessary, is appropriated from the Pennsylvania Economic 28 Revitalization Fund to the Department of Community Affairs 29 for the period beginning July 1, 1984, and ending June 30, 30 1987, for State grants-in-aid to municipalities for land 19870H0775B0845 - 2 -
1 acquisition, rehabilitation, studies and development projects 2 for recreation and conservation purposes, community centers 3 and open space benefits as specified in section 3. An 4 additional sum of $48,000,000, or as much thereof as may be 5 necessary, is appropriated from the Pennsylvania Economic 6 Revitalization Fund to the Department of Community Affairs 7 for the period beginning July 1, 1987, and ending June 30, 8 1990, to continue this State grants-in-aid program. The 9 appropriated funds shall be expended equally over [the] each 10 three-year funding period. Funding shall be allocated to 11 projects in accordance with the following: 12 (i) Not less than [50%] 25% of the total allocation 13 shall be used to pay up to 50% for rehabilitation, 14 studies and development projects. 15 (ii) Not more than [25%] 50% of the total allocation 16 shall be used to pay up to 50% of the project costs for 17 acquisition of recreation, park and open space benefit 18 lands. 19 (iii) Not more than 25% of the total allocation 20 shall be used to pay up to 50% for community center 21 projects. 22 (iv) The department shall develop a small community 23 or small projects component. This program shall be for 24 the above purposes and those under section 3. This 25 component shall be for grants-in-aid for projects of up 26 to $10,000 in amount, shall be up to 100% grants-in-aid 27 and will cover only material costs, to assist those 28 municipalities with a population of 4,000 or less 29 residents unable to meet the matching requirements 30 specified in this section. 19870H0775B0845 - 3 -
1 (v) No municipality shall be eligible to receive
2 more than $200,000 in grants-in-aid in any fiscal year.

4 Section 9. Termination.
5 No funds under this act shall be awarded as grants-in-aid by
6 the Department of Community Affairs after June 30, [1987] 1990.
7 All funds appropriated under section 4 to the Department of
8 Environmental Resources shall be encumbered by June 30, 1987,
9 and shall be expended by June 30, 1988.
10 Section 2. This act shall take effect immediately.
