AN ACT
1 Declaring certain indemnification covenants, promises,
2 agreements or understandings to be void and unenforceable;
3 and providing for limited exceptions.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Invalidity of certain covenants, promises and
7 agreements.
8 Any covenant, promise, agreement or understanding in or in
9 connection with, or collateral to, a contract or agreement
10 entered into on or after the effective date of this act,
11 relative to the construction, alteration, repair, addition to,
12 subtraction from, improvement to or maintenance of any building,
13 highway, road, railroad, water, sewer, electrical or gas
14 distribution system, excavation or other structure, project,
15 development or improvement attached to real estate, including
16 moving and demolition in connection therewith, purporting to
17 indemnify against liability for damages arising out of bodily
18 injury to persons or damage to property caused by or resulting
1 from the sole negligence of the indemnitee, his agents or
2 employees, is against public policy and is void and
3 unenforceable and no cause of action may be maintained thereon.
4 Section 2. Exemptions.
5 This act does not apply to construction bonds or insurance
6 contracts or agreements.
7 Section 3. Effective date.
8 This act shall take effect in 60 days.
