                                     AN ACT

     1  Amending the act of November 4, 1983 (P.L.217, No.63), entitled
     2     "An act establishing a program of limited pharmaceutical
     3     assistance for the elderly; granting powers to and imposing
     4     duties on the Department of Aging; establishing a payment
     5     system; making provisions for funding; providing for reports;
     6     and fixing penalties for violations of the pharmaceutical
     7     assistance program," further providing for proposals for the
     8     purpose of providing pharmaceutical assistance for the
     9     elderly.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 4 of the act of November 4, 1983
    13  (P.L.217, No.63), known as the Pharmaceutical Assistance
    14  Contract for the Elderly Act, is amended by adding a subsection
    15  to read:
    16  Section 4.  Responsibilities of Department of Aging.

     1     (d.1)  Additional requests for proposals.--The department
     2  shall prepare, as needed, requests for proposals in addition to
     3  that set forth in subsection (d), for the purpose of providing
     4  pharmaceutical assistance for the elderly within this
     5  Commonwealth. A request for proposal shall require private
     6  contractors to submit a proposal for a period of time and with
     7  monetary limitations as determined by the department. Upon the
     8  enactment of an appropriation from the State Lottery Fund, the
     9  Department of Revenue shall transmit the appropriated amount to
    10  the State Treasurer to be deposited in the Pharmaceutical
    11  Assistance Contract for the Elderly Fund. Funds not expended in
    12  the fiscal year in which they were appropriated shall not lapse
    13  and shall be available for use in the next fiscal year.

    15     Section 2.  This act shall take effect immediately.
