                                     AN ACT

     1  Providing for the waiver of tuition at certain colleges and
     2     universities for dependent children of police officers,
     3     firefighters and members of ambulance services and rescue
     4     squads who are killed in the performance of their duties; and
     5     making a repeal.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Short title.
     9     This act shall be known and may be cited as the Uniformed
    10  Officers' Dependent Children Tuition Waiver Act.
    11  Section 2.  Grounds for waiver of fees.
    12     The boards of trustees of all State-owned colleges and
    13  universities and all State-related universities shall waive the
    14  payment of tuition fees at their institutions for the dependent
    15  children of a police officer, paid or volunteer firefighter, or
    16  paid or volunteer member of an ambulance service or rescue squad
    17  killed in the performance of his duties.
    18  Section 3.  Performance of duty.


     1     A volunteer firefighter shall be deemed to be acting in the
     2  performance of his duties, for the purposes of this act, while
     3  going to or directly returning from a fire which the fire
     4  company or fire department attended, including travel from and
     5  direct return to a firefighter's home, place of business or
     6  other place where he was when he received the call or alarm;
     7  while participating in instruction fire drills in which the fire
     8  department or fire company participated; while repairing or
     9  doing other work about or on the fire apparatus or buildings and
    10  grounds of the fire company or fire department, upon the
    11  authorization of the chief of the fire company or fire
    12  department or other person in charge; while answering any
    13  emergency calls for any purpose; while riding upon the fire
    14  apparatus which is owned or used by the fire company or fire
    15  department; while performing any other duties of such fire
    16  company or fire department as authorized by the municipality; or
    17  while performing duties imposed by section 15, act of April 27,
    18  1927 (P.L.465, No.299), referred to as the Fire and Panic Act. A
    19  volunteer ambulance service or rescue squad member shall be
    20  deemed to be acting in the performance of his duties, for the
    21  purposes of this act, while going to or directly returning from
    22  an emergency which the ambulance service or rescue squad
    23  attended, including travel from and direct return to an
    24  ambulance service or rescue squad member's home, place of
    25  business or other place where he was when he received the call
    26  or alarm; while participating in drills in which the ambulance
    27  service or rescue squad participated; while repairing or doing
    28  other work about or on any emergency vehicle or buildings and
    29  grounds of the ambulance service or rescue squad upon the
    30  authorization of the chief of the ambulance service or rescue

     1  squad or other person in charge; while answering any emergency
     2  calls for any purpose; or while riding upon any vehicles which
     3  are owned or used by the ambulance service or rescue squad.
     4  Section 4.  Repeal.
     5     All acts and parts of acts are repealed insofar as they are
     6  inconsistent with this act.
     7  Section 5.  Effective date.
     8     This act shall take effect in 60 days.
