                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for prohibitions against
     6     nepotism.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 328.  Prohibition against Nepotism.--A.  No member of
    13  any board of school directors acting under the provisions of
    14  this act shall enter into any transaction or undertaking with
    15  any individual, corporation, association or other entity, where
    16  the direct or indirect result of such transaction or undertaking
    17  would confer a material financial benefit upon any member or the
    18  immediate family of any member. Any member who knowingly and
    19  wilfully violates the provisions of this section shall


     1  immediately forfeit membership on the board along with whatever
     2  civil or criminal penalties may be applied.
     3     For the purposes of this section, the terms "transaction" and
     4  "undertaking" shall include, but not be limited to, the
     5  investment of funds of any school district, the awarding of
     6  contracts and the hiring of employes. Also, the term "immediate
     7  family" shall include parents, spouses, brothers and sisters,
     8  children and adopted children of the members, and the spouses of
     9  those children and adopted children.
    10     Section 2.  This act shall take effect in 60 days.
