           REPRESENTATIVES, AS AMENDED, MARCH 9, 1987

                                     AN ACT

     1  Providing an additional appropriation for senior judges in the    <--
     2     courts of common pleas.
     3  AMENDING TITLE 42 (JUDICIARY AND JUDICIAL PROCEDURE) OF THE       <--
     4     PENNSYLVANIA CONSOLIDATED STATUTES, FURTHER PROVIDING FOR THE
     5     AUGMENTATION OF THE SENIOR JUDGES COURT OF COMMON PLEAS
     6     APPROPRIATION WITH EXCESS FUNDS FROM THE COURT OF COMMON
     7     PLEAS APPROPRIATION.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The following sums, or as much thereof as may be   <--
    11  necessary, are hereby appropriated from the General Fund to the
    12  hereinafter named agencies of the Commonwealth for the fiscal
    13  year beginning July 1, 1986:
    14                       Courts of Common Pleas
    15     For senior judges of the courts of
    16  common pleas. Senior judges working as
    17  active or senior judges a minimum of
    18  75 days in the prior calendar year are


     1  to receive health benefits. Senior
     2  judges shall not be assigned unless
     3  adequate funds are available in this
     4  appropriation to provide compensation.
     5  Any senior judge assigned in excess of
     6  existing funding shall be compensated
     7  from the appropriation for the Supreme
     8  Court.................................                  $657,000
     9     Section 2.  The appropriation contained in section 1 of this
    10  act shall be in addition to any funds provided for the same
    11  purpose in the act of July 1, 1986 (P.L.    , No.5A), known as
    12  the General Appropriation Act of 1986.
    13     Section 3.  This act shall take effect immediately.
    14     SECTION 1.  TITLE 42 OF THE PENNSYLVANIA CONSOLIDATED          <--
    15  STATUTES IS AMENDED BY ADDING A SECTION TO READ:
    16  § 3526.1.  AUGMENTATION OF SENIOR JUDGE APPROPRIATION.
    17     (A)  GENERAL RULE.--NOTWITHSTANDING THE PROVISIONS OF SECTION
    18  284 OF THE ACT OF JULY 2, 1986 (P.L.    , NO.5A), KNOWN AS THE
    19  GENERAL APPROPRIATION ACT OF 1986, THE COURT ADMINISTRATOR MAY
    20  AUGMENT THE APPROPRIATION FOR SENIOR JUDGES OF THE COURT OF
    21  COMMON PLEAS BY USING FUNDS APPROPRIATED FOR THE COURT OF COMMON
    22  PLEAS WHICH ARE IN EXCESS OF THE NEEDS OF THAT COURT DUE TO
    23  VACANCIES OR SUSPENSIONS.
    24     (B)  EXPIRATION.--THIS SECTION SHALL EXPIRE JUNE 30, 1987.
    25     SECTION 2.  THIS ACT SHALL TAKE EFFECT IMMEDIATELY.
