                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for eligibility for a processing
     3     fee in lieu of a registration fee.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1901(c)(16) of Title 75 of the
     7  Pennsylvania Consolidated Statutes is amended to read:
     8  § 1901.  Exemption of entities and vehicles from fees.

    10     (c)  Processing fee in lieu of registration fee.--No
    11  registration fee shall be charged for vehicles registered by any
    12  of the following but the department shall charge a fee of $10 to
    13  cover the costs of processing for issuing or renewing the
    14  registration:

     1         (16)  Any person who is retired and receiving social
     2     security or other pension and whose total income [does not
     3     exceed $14,999 per year], in the case of a single person,
     4     does not exceed $15,000 per year or, in the case of a married
     5     person, the combined total income of such person and his or
     6     her spouse does not exceed $20,000 per year. Unless the
     7     retired person is physically or mentally incapable of driving
     8     the vehicle, the retired person shall be the principal driver
     9     of the vehicle but may from time to time authorize another
    10     person to drive the vehicle in his or her stead. The total
    11     amount of money which is annually lost due to benefits
    12     received by those individuals who are eligible for or are
    13     receiving benefits pursuant to the act of March 11, 1971
    14     (P.L.104, No.3), known as the "Senior Citizens Rebate and
    15     Assistance Act," by the Department of Transportation by
    16     operation of this paragraph based on the difference between
    17     the normal registration fee and the processing fee shall be
    18     appropriated from the Lottery Fund to the Motor License Fund.
    19     The Governor is hereby authorized to annually transfer from
    20     the Lottery Fund the necessary amount of money to reimburse
    21     the Motor License Fund pursuant to this paragraph. Such money
    22     is hereby specifically appropriated to the Motor License Fund
    23     to be expended by the Department of Transportation with the
    24     approval of the Governor.
