                                     AN ACT

     1  Amending the act of November 4, 1983 (P.L.217, No.63), entitled
     2     "An act establishing a program of limited pharmaceutical
     3     assistance for the elderly; granting powers to and imposing
     4     duties on the Department of Aging; establishing a payment
     5     system; making provisions for funding; providing for reports;
     6     and fixing penalties for violations of the pharmaceutical
     7     assistance program," changing eligibility requirements.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The definition of "eligible claimant" in section
    11  3 of the act of November 4, 1983 (P.L.217, No.63), known as the
    12  Pharmaceutical Assistance Contract for the Elderly Act, is
    13  amended to read:
    14  Section 3.  Definitions.
    15     The following words and phrases when used in this act shall
    16  have the meanings given to them in this section unless the
    17  context clearly indicates otherwise:

    19     "Eligible claimant."  A resident of the Commonwealth 62 years


     1  of age and over who is receiving early retirement benefits under
     2  the Federal Social Security Act (Public Law 74-271, 42 U.S.C. §
     3  301 et seq.), or 65 years of age and over, whose annual income
     4  is less than the maximum annual income, and who is not otherwise
     5  qualified for public assistance under the act of June 13, 1967
     6  (P.L.31, No.21), known as the Public Welfare Code.

     8     Section 2.  This act shall take effect in 60 days.
