To the Members of the House of Representatives and Senate:
We, the undersigned, Committee of Conference on the part of the House of Representatives and Senate for the purpose of considering House Bill No. 210, entitled: "An act amending the act of December 22, 1983 (P.L.306, No.84), entitled 'An act providing for the State Board of Vehicle Manufacturers, Dealers and Salespersons; and providing penalties,' FURTHER PROVIDING FOR APPROVAL OF VEHICLE SHOWS AND EXHIBITIONS; AND exempting from certain board approval all vehicle shows and exhibitions conducted during and at certain fairs, OR CONDUCTED BY CHARITABLE ORGANIZATIONS," respectfully submit the following bill as our report: FRANK W. AN ACT 1 Amending the act of December 22, 1983 (P.L.306, No.84), entitled 2 "An act providing for the State Board of Vehicle 3 Manufacturers, Dealers and Salespersons; and providing 4 penalties," providing for vehicle shows. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 23 of the act of December 22, 1983 8 (P.L.306, No.84), known as the Board of Vehicles Act, is 9 repealed. 10 Section 2. The act is amended by adding sections to read: 11 Section 23.1. Vehicle shows, off-premise sales and exhibitions. 12 (a) Participation.--Any licensed dealer or manufacturer may 13 participate in public vehicle shows, off-premise sales and 14 exhibitions, provided that if a dealer is otherwise limited to a 15 particular relevant market area, such dealer shall only 16 participate in shows, off-premise sales and exhibitions held 17 within that relevant market area. 18 (b) Application of section.--The provisions of this section 19 relating to "relevant market area" shall not apply to vehicle 20 shows held as part of, and in conjunction with, the following: 21 (1) An event operated to benefit a charitable 22 organization or group of organizations approved under section 23 501(c)(3) of the Internal Revenue Code of 1954 (68A Stat. 3, 24 26 U.S.C. § 501(c)(3)). 25 (2) A community or agricultural fair which receives 26 funds from the Pennsylvania Fair Fund. 27 Section 23.2. Shows or exhibits on Sundays. 28 (1) Vehicle shows or exhibits shall be permitted to be 29 open on Sundays. 30 (2) Normal vehicle business practices shall be allowed
