AN ACT 1 Amending Title 34 (Game) of the Pennsylvania Consolidated 2 Statutes, safeguarding the public from attack by exotic 3 wildlife. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Sections 2962(c), 2963(c) and 2964(c) of Title 34 7 of the Pennsylvania Consolidated Statutes are amended to read: 8 § 2962. Exotic wildlife dealer permits. 9 * * * 10 (c) Unlawful acts.--It is unlawful for any person to: 11 (1) Import into this Commonwealth, possess, buy, sell, 12 locate or find for a fee, barter, donate, give away or 13 otherwise dispose of more than one bird or one animal 14 classified as exotic wildlife in any calendar year without 15 first securing a permit issued under this section. 16 (2) Release exotic wildlife into the wild. 17 (3) Fail to exercise due care in safeguarding the public 18 from attack by exotic wildlife.
1 (4) Recklessly engage in conduct which places or may 2 place another person in danger of attack by exotic wildlife. 3 * * * 4 § 2963. Exotic wildlife possession permits. 5 * * * 6 (c) Unlawful acts.--It is unlawful for any person to: 7 (1) Possess, purchase or receive exotic wildlife, 8 without first securing a permit to possess exotic wildlife 9 issued under this section or regulations pertaining to this 10 section. 11 (2) Release exotic wildlife into the wild. 12 (3) Fail to exercise due care in safeguarding the public 13 from attack by exotic wildlife. 14 (4) Recklessly engage in conduct which places or may 15 place another person in danger of attack by exotic wildlife. 16 * * * 17 § 2964. Menagerie permits. 18 * * * 19 (c) Unlawful acts.--It is unlawful to: 20 (1) Keep any wild bird or wild animal in captivity for 21 public exhibition, or to have any wild bird or wild animal in 22 custody or control for such purpose, without first securing a 23 permit issued by the commission. 24 (2) Violate any of the provisions of this section or to 25 release any bird or animal into the wild. 26 (3) Fail to exercise due care in safeguarding the public 27 from attack by exotic wildlife. 28 (4) Recklessly engage in conduct which places or may 29 place another person in danger of attack by exotic wildlife. 30 * * * 19870H0167B0185 - 2 -
