           FISHER, PECORA, STOUT, SINGEL AND O'PAKE, OCTOBER 16, 1985

        AS AMENDED ON SECOND CONSIDERATION, NOVEMBER 19, 1985

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for reimbursements
     6     by the Commonwealth.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 2502.5(e) of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended July 1, 1985 (P.L.103, No.31), is amended to read:
    12     Section 2502.5.  Limitation of Certain Payments.--* * *
    13     (e)  [For the school year 1983-1984 and each school year
    14  thereafter, no] (1)  No school district shall be paid under
    15  subsections (d) and (e) of section 2502 and under section
    16  2502.11 less than [eighty percent (80%)] the specified
    17  percentage of the total amount to which it is entitled under
    18  said sections, notwithstanding any limitations on increases in
    19  such payments enacted by the General Assembly to the contrary.

     1  The specified percentages are as follows: (i) eighty percent
     2  (80%) for the school year YEARS 1983-1984 AND 1984-1985; and      <--
     3  (ii) eighty-two and five-tenths percent (82.5%) EIGHTY-THREE AND  <--
     4  FIVE-TENTHS PERCENT (83.5%) for the school year 1984-1985 1985-   <--
     5  1986 and each school year thereafter.
     6     (2)  For the school year 1983-1984, payments under this
     7  subsection shall be computed using a Factor for Educational
     8  Expense of one thousand six hundred fifty-six dollars ($1,656)
     9  and a maximum payment increase of seven and forty-five one
    10  hundredths percent (7.45%) and a minimum payment increase of two
    11  percent (2%).
    12     (3)  For the school year 1984-1985 and each school year
    13  thereafter, payments under this subsection shall be computed
    14  using the Factor for Educational Expense as defined in section
    15  2501(19) and minimum and maximum increase limits provided for in
    16  subsection (b) of this section.
    17     (4)  No school district shall, as a result of this
    18  subsection, be paid an amount in excess of one hundred percent
    19  (100%) of the total reimbursable instructional expenditures of
    20  the school district.
    21     Section 2.  This act shall take effect immediately JULY 1,     <--
    22  1986.
