        INTRODUCED BY SHAFFER, SINGEL, SCANLON, REIBMAN, FISHER,
           HELFRICK, CORMAN, RHOADES, ANDREZESKI AND O'CONNELL,

        SENATOR FISHER, ENVIRONMENTAL RESOURCES AND ENERGY, AS AMENDED,
           FEBRUARY 25, 1985

                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," providing for water and
    21     sewage line rights-of-way in State parks.

    22     The General Assembly of the Commonwealth of Pennsylvania
    23  hereby enacts as follows:
    24     Section 1.  Section 1906-A of the act of April 9, 1929
    25  (P.L.177, No.175), known as The Administrative Code of 1929, is
    26  amended by adding a clause CLAUSES to read:                       <--

     1     Section 1906-A.  Parks.--The Department of Environmental
     2  Resources shall have the power, and its duty shall be:
     3     * * *
     4     (10)  To grant rights-of-way in and through State parks to
     5  municipal authorities and political subdivisions of this
     6  Commonwealth for the laying of water lines and of lines for the
     7  transportation of sewage to sewage lines or sewage treatment
     8  facilities on State park land, under such terms and conditions,
     9  including the payment of fees, as the department may deem
    10  proper, and when it shall appear that the grant of such right-
    11  of-way will not so adversely affect the land as to interfere
    12  with its usual and orderly administration and that the interests
    13  of the Commonwealth or its citizens will be promoted by such
    14  grant.
    15     (11)  TO ISSUE PERMITS UNDER EMERGENCY SITUATIONS, UPON SUCH   <--
    16  TERMS AND SUBJECT TO SUCH RESTRICTIONS, FEES AND REGULATIONS AS
    17  THE DEPARTMENT MAY DEEM PROPER, FOR THE UTILIZATION OF WATER AT
    18  A STATE PARK AND FOR CONSTRUCTING, MAINTAINING AND OPERATING
    19  LINES OF PIPES UPON AND THROUGH A STATE PARK FOR THE PURPOSE OF
    20  CONVEYING WATER THEREFROM, WHEREVER IT SHALL BE IN THE PUBLIC
    21  INTEREST TO DO SO.
    22     Section 2.  This act shall take effect immediately.
