AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for homicide by vehicle.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Section 3732 of Title 75 of the Pennsylvania
6 Consolidated Statutes is amended to read:
7 § 3732. Homicide by vehicle.
8 Any person who unintentionally causes the death of another
9 person while engaged in the violation of any law of this
10 Commonwealth or municipal ordinance applying to the operation or
11 use of a vehicle or to the regulation of traffic except section
12 3731 (relating to driving under influence of alcohol or
13 controlled substance) is guilty of homicide by vehicle, a
14 misdemeanor of the first degree, when the violation is the cause
15 of death, or a felony of the first degree, if the person was
16 fleeing the scene of a crime which he perpetrated or was an
17 accomplice to, and the violation is the cause of death.
1 Section 2. This act shall take effect in 60 days.
