HOUSE RESOLUTION

No. 356 Session of 1986

           ARTY, JOHNSON, LASHINGER, PISTELLA, BATTISTO, FOX, WOGAN AND

                            A CONCURRENT RESOLUTION

     1  Directing the Leadership Committee, established pursuant to Act
     2     1981-142, to oversee the codification of certain titles of
     3     the Pennsylvania Consolidated Statutes.

     4     WHEREAS, A program of codification of the laws of the
     5  Commonwealth of Pennsylvania was begun by the General Assembly
     6  with the act of November 25, 1970 (P.L.707, No.230), entitled
     7  "An act codifying and compiling a part of the law of the
     8  Commonwealth," which established the structure of the
     9  Pennsylvania Consolidated Statutes; and
    10     WHEREAS, After 16 years, only one-third of the subject titles
    11  have been at least partially codified, and Pennsylvania remains
    12  the only state with its laws largely uncodified; and
    13     WHEREAS, While there are several titles of the Pennsylvania
    14  Consolidated Statutes which have been enacted in whole or in
    15  part and several other titles which are presently in bill form
    16  before the General Assembly, there are certain other titles on
    17  which little work or no work has been done, namely: Titles 3
    18  (Agriculture), 4 (Amusements), 6 (Bailees and Factors), 7 (Banks

     1  and Banking), 8 (Boroughs and Incorporated Towns), 10
     2  (Charities), 11 (Cities), 12 (Commerce and Trade), 14 (Community
     3  Affairs), 16 (Counties), 27 (Environmental Resources), 28
     4  (Escheats), 29 (Federal Relations), 31 (Food), 33 (Frauds,
     5  Statute of), 36 (Highways and Bridges), 37 (Historical and
     6  Museums), 38 (Holidays and Observances), 39 (Insolvency and
     7  Assignments), 43 (Labor), 44 (Law and Justice), 46
     8  (Legislature), 47 (Liquor), 48 (Lodging and Housing), 50 (Mental
     9  Health), 52 (Mines and Mining), 57 (Notaries Public), 58 (Oil
    10  and Gas), 60 (Peddlers), 61 (Penal and Correctional
    11  Institutions), 63 (Professions and Occupations), 64 (Public
    12  Authorities and Quasi-Public Corporations), 65 (Public
    13  Officers), 69 (Savings and Validating Provisions), 70
    14  (Securities), 71 (State Government), 73 (Townships), 76
    15  (Weights, Measures and Standards), 78 (Zoning and Planning) and
    16  79 (Supplementary Provisions); and
    17     WHEREAS, The codification of the laws of the Commonwealth of
    18  Pennsylvania continues to be the policy and an important goal of
    19  the General Assembly; therefore be it
    20     RESOLVED (the Senate concurring), That the Leadership
    21  Committee, established pursuant to section 3 of the act of
    22  December 22, 1981 (P.L.508, No.142), known as the Sunset Act,
    23  oversee the codification of the above-named titles and the
    24  codification of any other subjects the committee deems
    25  appropriate; and be it further
    26     RESOLVED, That such committee shall appoint a full-time
    27  executive director and may employ such personnel as are
    28  necessary to carry out the development of proposals which would
    29  codify the above-named titles as law, when enacted pursuant to
    30  the provisions of Article III of the Constitution of

     1  Pennsylvania, and that such committee be authorized to contract
     2  for necessary services and obtain grants or accept services in
     3  kind with no obligation to the Commonwealth; and be it further
     4     RESOLVED, That the sum of $300,000, or as much thereof as may
     5  be necessary, is hereby made available for the purposes of this
     6  resolution and shall be paid in equal annual installments
     7  equally from funds of the Chief Clerk of the Senate and the
     8  Chief Clerk of the House of Representatives; and be it further
     9     RESOLVED, That this committee coordinate and use the
    10  technical resources of the Legislative Reference Bureau, the
    11  Legislative Data Processing Center and the Joint State
    12  Government Commission, and consult with experts in the subjects
    13  to be codified, as may be appropriate, to carry out its
    14  assignment; and be it further
    15     RESOLVED, That this committee provide the General Assembly
    16  with these codifications within three years of the date of the
    17  final adoption of this resolution.
