HOUSE RESOLUTION

No. 165 Session of 1985


        INTRODUCED BY KOSINSKI, LINTON, PISTELLA, DeWEESE, GALLAGHER,
           GREENWOOD, SHOWERS, JOSEPHS, BLAUM, TRELLO, RAYMOND, GEIST,
           FOX, NAHILL, MORRIS AND STABACK, OCTOBER 1, 1985

        REFERRED TO RULES, OCTOBER 2, 1985

                                  A RESOLUTION

     1  Memorializing the Environmental Protection Agency to continue
     2     existing odor regulations.

     3     WHEREAS, Pursuant to the Federal Clean Air Act, in 1972 the
     4  Pennsylvania Department of Environmental Resources submitted to
     5  the Environmental Protection Agency and received approval on a
     6  State implementation plan providing for the attainment and
     7  maintenance of the National Ambient Air Quality Standards; and
     8     WHEREAS, This plan included the Commonwealth's odor emission
     9  regulation and the City of Philadelphia's odor emission program;
    10  and
    11     WHEREAS, Many residents of our Commonwealth, especially those
    12  in heavily industrialized areas, rely on the enforcement of the
    13  Federal odor regulations as the only means available to control
    14  hazardous air pollutants; and
    15     WHEREAS, In the heavily industrialized area of Philadelphia,
    16  where the cancer rate is more than double the national average,


     1  toxic air emissions such as benzine and extremely putrid and
     2  toxic substances such as hydrogen sulfide, sulfur dioxide and
     3  nitrogen oxide are regularly emitted, and must be controlled, or
     4  the cancer rate will grow even higher and living conditions will
     5  be rendered unbearable; and
     6     WHEREAS, The Environmental Protection Agency now proposes to
     7  delete from the Federally approved Pennsylvania State
     8  implementation plan those portions of the regulations relating
     9  to odor emission controls; and
    10     WHEREAS, If the Environmental Protection Agency revokes these
    11  odor regulations, no community in Pennsylvania will be able to
    12  overcome problems of toxic air pollution or to protect the
    13  public health from chemical hazards in the community air;
    14  therefore be it
    15     RESOLVED, That the House of Representatives of the
    16  Commonwealth of Pennsylvania memorialize the Environmental
    17  Protection Agency to continue the existing odor regulations in
    18  effect; and be it further
    19     RESOLVED, That the House of Representatives go on record as
    20  being strongly opposed to the Environmental Protection Agency
    21  proposal to revoke the odor regulations; and be it further
    22     RESOLVED, That a copy of this resolution be transmitted to
    23  Lee M. Thomas, Administrator of the Environmental Protection
    24  Agency, 401 M Street, S.W., Washington, DC 20460, and also to
    25  each member of Congress from Pennsylvania.
