                            A CONCURRENT RESOLUTION

     1  Expressing the intent of the General Assembly relative to the
     2     resolution procedure used to extend the life of certain
     3     agencies subject to the Sunset Act.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby resolves as follows:
     6     WHEREAS, The General Assembly passed and the Governor signed
     7  Senate Bill No. 108 of 1981 as the act of December 22, 1981
     8  (P.L.508, No.142), known as the Sunset Act, which provides a
     9  procedure for the review of various State agencies according to
    10  certain time schedules; and
    11     WHEREAS, Section 7 of the Sunset Act provides two methods for
    12  extending or continuing the agencies by means of legislation or
    13  resolution; and
    14     WHEREAS, The resolution provisions of section 7 provides for

     1  the utilization of this procedure only after November 1 of each
     2  review year, thus permitting the General Assembly to retain
     3  agencies where little or no time remains for a thorough review;
     4  therefore be it
     5     RESOLVED (the Senate concurring), That the General Assembly
     6  express its intent that the resolution procedure utilized in
     7  section 7 of the Sunset Act was and is strictly an informal
     8  procedural device, not legislative in character, to continue
     9  agencies subject to termination; and be it further
    10     RESOLVED, That as an informal procedural device, not
    11  legislative in character, the resolution in section 7 is not and
    12  was not intended to be subject to the review or approval of the
    13  Governor; and be it further
    14     RESOLVED, That the Chief Clerk of the House of
    15  Representatives transmit this resolution, after approval, to the
    16  Governor and the Attorney General.
