AN ACT
1 Amending the act of September 30, 1983 (P.L.160, No.39),
2 entitled "An act establishing salaries and compensation of
3 certain public officials including justices and judges of
4 Statewide courts, judges of courts of common pleas, judges of
5 the Philadelphia Municipal Court, judges of the Philadelphia
6 Traffic Court, district justices and the Governor, the
7 Lieutenant Governor, the State Treasurer, the Auditor
8 General, the Attorney General and certain other State
9 officers and the salary and certain expenses of the members
10 of the General Assembly; and repealing certain inconsistent
11 acts," increasing the compensation of justices and judges of
12 Statewide courts, judges of courts of common pleas, judges of
13 the Philadelphia Municipal Court, judges of the Philadelphia
14 Traffic Court and district justices.
15 The General Assembly of the Commonwealth of Pennsylvania
16 hereby enacts as follows:
17 Section 1. Section 2 of the act of September 30, 1983
18 (P.L.160, No.39), known as the Public Official Compensation Law,
19 is amended to read:
20 Section 2. Judiciary.
21 (a) Supreme Court.--The annual salary of the Chief Justice
22 of the Supreme Court shall be [$79,000] $94,000 and the annual
23 salary of each of the other justices of the Supreme Court shall
1 be [$76,500] $91,500. 2 (b) Superior Court.--The annual salary of the President 3 Judge of the Superior Court shall be [$76,000] $91,000 and the 4 annual salary of the other judges of the Superior Court shall be 5 [$74,500] $89,500. 6 (c) Commonwealth Court.--The annual salary of the President 7 Judge of the Commonwealth Court shall be [$76,000] $91,000. The 8 annual salary of each of the other judges of the Commonwealth 9 Court shall be [$74,500] $89,500. 10 (d) Courts of common pleas.-- 11 (1) The annual salary of a president judge of a court of 12 common pleas shall be fixed in accordance with the following 13 schedule: 14 (i) Allegheny County, [$67,000] $82,000. 15 (ii) Philadelphia, [$67,500] $82,500. 16 (iii) Judicial districts having six or more judges, 17 [$66,000] $81,000. 18 (iv) Judicial districts having three to five judges, 19 [$65,500] $80,500. 20 (v) Judicial districts having one or two judges, 21 [$65,000] $80,000. 22 (vi) Administrative judges of the divisions of the 23 Court of Common Pleas of Philadelphia County; divisions 24 of six or more judges, [$66,000] $81,000. 25 (vii) Administrative judges of the divisions of the 26 Court of Common Pleas of Philadelphia County with 27 divisions of five or less judges, [$65,500] $80,500. 28 (viii) Administrative judge of divisions of the 29 Court of Common Pleas of Allegheny County with divisions 30 of six or more judges, [$66,000] $81,000. 19860H2769B3986 - 2 -
1 (ix) Administrative judge of divisions of the Court 2 of Common Pleas of Allegheny County of five or less 3 judges, [$65,500] $80,500. 4 (2) The other judges of the courts of common pleas shall 5 be paid an annual salary of [$65,000.] $80,000. 6 (e) Philadelphia Municipal Court.--The President Judge of 7 the Philadelphia Municipal Court shall receive an annual salary 8 of $75,500. The annual salary for the other judges of the 9 Philadelphia Municipal Court shall be $74,000. 10 (f) Philadelphia Traffic Court.--The President Judge of the 11 Philadelphia Traffic Court shall receive an annual salary of 12 $46,000. The annual salary for the other judges of the 13 Philadelphia Traffic Court shall be $45,000. 14 (g) District justices.--A district justice shall receive an 15 annual salary payable by the Commonwealth and computed by adding 16 to $31,500 the product of the population of his magisterial 17 district times $1, but in no event shall the salary exceed 18 $44,500. Furthermore, the annual salary for each magisterial 19 district shall be increased from the salary level existing prior 20 to this amendatory act by no more than $10,000. 21 (h) Senior judges.--The compensation of the senior judges 22 pursuant to 42 Pa.C.S. § 4121 (relating to assignment of judges) 23 shall be [$200] $250 per day. In any calendar year the amount of 24 compensation which a senior judge shall be permitted to earn as 25 a senior judge shall not, when added to retirement income paid 26 by the Commonwealth for such senior judge, exceed the 27 compensation payable by the Commonwealth to a judge then in 28 regular active service on the court from which said senior judge 29 retired. A senior judge who so elects may serve without being 30 paid all or any portion of the compensation provided by this 19860H2769B3986 - 3 -
1 section. 2 Section 2. Sections 1517, 1518 and 1519 of Title 42 of the 3 Pennsylvania Consolidated Statutes are repealed. 4 Section 3. This act shall take effect in 60 days. I22L71CHF/19860H2769B3986 - 4 -
