AN ACT 1 Amending the act of June 3, 1937 (P.L.1333, No.320), entitled 2 "An act concerning elections, including general, municipal, 3 special and primary elections, the nomination of candidates, 4 primary and election expenses and election contests; creating 5 and defining membership of county boards of elections; 6 imposing duties upon the Secretary of the Commonwealth, 7 courts, county boards of elections, county commissioners; 8 imposing penalties for violation of the act, and codifying, 9 revising and consolidating the laws relating thereto; and 10 repealing certain acts and parts of acts relating to 11 elections," requiring direct notice to candidates where 12 unofficial election results differ from official results. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. Section 302(l) of the act of June 3, 1937 16 (P.L.1333, No.320), known as the Pennsylvania Election Code, is 17 amended to read: 18 Section 302. Powers and Duties of County Boards.--The county 19 boards of elections, within their respective counties, shall 20 exercise, in the manner provided by this act, all powers granted 21 to them by this act, and shall perform all the duties imposed 22 upon them by this act, which shall include the following:
1 * * * 2 (l) To publicly announce by posting at its office the results 3 of primaries and elections for county, city, borough, township, 4 ward, school district, poor district, election offices, and 5 party offices, if any, and to issue certificates of election to 6 the successful candidates for said offices. Whenever the 7 unofficial results posted differ from the final official 8 results, and that difference affects the outcome of the election 9 or nomination, the board shall promptly give direct notice of 10 that fact to those candidates affected. 11 * * * 12 Section 2.
