                                     AN ACT

     1  Providing for self-insurance for State boards and commissions;
     2     declaring certain members immune from civil liability; and
     3     establishing the Board and Commission Self-Insurance Fund.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Board and
     8  Commission Self-Insurance Law.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Boards and commissions."  All independent boards and
    14  commissions, all administrative boards and commissions, all
    15  authorities of the Commonwealth and all agencies of the
    16  Commonwealth commonly described as housing, finance, economic
    17  development or redevelopment agencies. The term does not include
    18  municipal authorities created under the act of May 2, 1945

     1  (P.L.382, No.164), known as the Municipality Authorities Act of
     2  1945.
     3  Section 3.  Self-insurance.
     4     All boards and commissions shall, where economically
     5  feasible, self-insure under this act for civil liability
     6  purposes.
     7  Section 4.  Immunity of certain members.
     8     All members of boards and commissions who are not otherwise
     9  officials or employees of the Commonwealth are hereby declared
    10  to be immune from civil liability for any action taken as
    11  members of their respective boards or commissions.
    12  Section 5.  Board and Commission Self-Insurance Fund.
    13     (a)  Establishment.--There is hereby established a separate
    14  account in the State Treasury to be known as the Board and
    15  Commission Self-Insurance Fund.
    16     (b)  Purpose.--The purpose of the fund shall be to provide
    17  moneys to satisfy any civil liability suit or claim brought
    18  against any board or commission which self-insures under this
    19  act.
    20     (c)  Funds.--The fund shall be composed of funds which the
    21  General Assembly may, from time to time, appropriate.
    22  Section 6.  Effective date.
    23     This act shall take effect in 60 days.
