                                     AN ACT

     1  Authorizing the release of Project 70 restrictions imposed on
     2     certain lands owned by the City of Scranton, Lackawanna
     3     County, in return for the imposition of Project 70
     4     restrictions on certain lands owned by the City of Scranton.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Authorization.
     8     Pursuant to the requirements of section 20(b) of the act of
     9  June 22, 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70
    10  Land Acquisition and Borrowing Act, the General Assembly hereby
    11  authorizes the release of the restrictions imposed by section 20
    12  of the Project 70 Land Acquisition and Borrowing Act from the
    13  lands owned by the City of Scranton, Lackawanna County and more
    14  particularly described in section 3 in exchange for the
    15  imposition of the section 20 restrictions on lands owned by the
    16  City of Scranton, Lackawanna County, and more particularly
    17  described in section 4.
    18  Section 2.  Freedom of restrictions.


     1     The lands described in section 3 and owned by the City of
     2  Scranton, Lackawanna County, shall be free of the restrictions
     3  on use and alienation imposed by section 20 of the act of June
     4  22, 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70 Land
     5  Acquisition and Borrowing Act, upon the imposition of and
     6  recording of the Project 70 deed restrictions set forth in
     7  section 5 on the parcel of replacement land owned by the City of
     8  Scranton and located in the City of Scranton, Lackawanna County,
     9  described in section 4.
    10  Section 3.  Land to be free from restrictions.
    11     The parcel of land authorized to be released from
    12  restrictions is more particularly described as follows:
    13     Beginning at an iron pin corner in the northeasterly sideline
    14  of Eynon Street, said beginning corner being in the division
    15  line between city assessment lot number 32 and lot number 47 in
    16  city assessment block number 8 in the 15th ward; thence, north
    17  42 degrees 00 minutes 00 seconds east along the said division
    18  line between lots number 32 and 47 for a distance of 117 feet to
    19  an iron pin corner, said last mentioned iron pin corner being
    20  located 16 feet southwesterly along said division line between
    21  said lots from the southwesterly sideline of Hand Place; thence,
    22  through, over and across the rear portions of lots fronting on
    23  said Eynon Street south 47 degrees 45 minutes 00 seconds east
    24  for a distance of 455.13 feet to an iron pin corner, said last
    25  mentioned line being located 16 feet southwesterly from and
    26  parallel with the said southwesterly sideline of Hand Place;
    27  thence, along a curve to the right whose radius is 30 feet and
    28  its length of arc being 46.99 feet and its chord being along a
    29  line bearing south 02 degrees 52 1/2 minutes 00 seconds east for
    30  a distance of 42.33 feet to an iron pin corner; thence, south 42

     1  degrees 00 minutes 00 seconds west for a distance of 371 feet to
     2  an iron pin corner, said last mentioned line being located 10
     3  feet northwesterly from and parallel with the northwesterly
     4  sideline of South Sixth Avenue, said last mentioned line also
     5  crosses parts of lots along said South Sixth Avenue, Eynon
     6  Street and Regan Place; thence, along a curve to the right whose
     7  radius is 30 feet and its length of arc being 47.25 feet and its
     8  chord being along a line bearing south 87 degrees 07 1/2 minutes
     9  00 seconds west for a distance of 42.52 feet to an iron pin
    10  corner; thence, through, over and across the front portions of
    11  lots fronting on West Elm Street, north 47 degrees 45 minutes 00
    12  seconds west for a distance of 353 feet to an iron pin corner,
    13  said last mentioned line being located 10 feet northeasterly
    14  from and parallel with the said northeasterly sideline of West
    15  Elm Street; thence, along a curve to the right whose radius is
    16  30 feet and its length of arc being 46.99 feet and its chord
    17  being along a line bearing north 02 degrees 52 1/2 minutes 00
    18  seconds west for a distance of 42.33 feet to an iron pin corner;
    19  thence, north 42 degrees 00 minutes 00 seconds east for a
    20  distance of 284.13 feet to an iron pin corner in the first
    21  mentioned northeasterly sideline of Eynon Street; thence, north
    22  47 degrees 45 minutes 00 seconds west along said northeasterly
    23  sideline of Eynon Street for a distance of 72 feet to a corner,
    24  the place of beginning.
    25     Containing 185,851.75 square feet of land, be the same, more
    26  or less.
    27     Comprising all of city assessment lots numbered 27B and 28B
    28  in city assessment block number 42 in the 15th ward and portions
    29  of city assessment lots numbered 18, 19, 20, 21, 22, 23, 24,
    30  25A, 25B, 26A, 26B, 27A, 27C and 28A in city assessment block

     1  number 42 in the 15th ward. Also portions of city assessment
     2  lots numbered 1, 1A, 8 and all of city assessment lots numbered
     3  2A, 2B, 3, 4, 4A, 5, 6 and 7 in city assessment block number 7
     4  in the 15th ward, and also portions of city assessment lots
     5  numbered 32, 33, 48, 34, 35A, 35B, 36, 49, 37, 38, 39, 40 and
     6  40A in city assessment block number 8 in the 15th ward, also a
     7  413 foot portion of both Eynon Street and Regan Place abutting
     8  the said lots, which are to be vacated.
     9     Bearings of the above description are as the magnetic needle
    10  pointed in March 1966.
    11     Subject to two utility easements, being that portion of Eynon
    12  Street, 413 feet in length by 40 feet in width and also that
    13  portion of Regan Place, 413 feet in length by 15 feet in width,
    14  inclusive of two portions of land 413 feet in length by 2.5 feet
    15  in width abutting both the northeasterly and southwesterly
    16  sidelines of said Regan Place.
    17  Section 4.  Land on which restrictions are to be imposed.
    18     The replacement parcel to be subject to restrictions in
    19  exchange for the parcel described in section 3 is more
    20  particularly described as follows:
    21     Beginning in the line between land known as the Reynolds
    22  Brothers and McCarthy Plot or tract and land known as the Thomas
    23  Canavan Tract, at a point where the said line intersects the
    24  easterly right-of-way line of the D.L. & W. Railroad; thence,
    25  south 52 degrees 30 minutes 00 seconds east about 440 feet, more
    26  or less, along the line between the aforesaid tract to the
    27  westerly right-of-way line of Interstate Route No. 81; thence,
    28  south 12 degrees 15 minutes 00 seconds west about 592 feet, more
    29  or less, along the said right-of-way line to a point; thence,
    30  north 52 degrees 30 minutes 00 seconds west along lands of

     1  Interstate Route No. 81 a distance of about 50 feet, more or
     2  less, to a point; thence, in a southwest direction along a one
     3  (1) degree curve running along the land of Interstate Route No.
     4  81 a distance of about 100 feet, more or less, to the line
     5  between land known as the Thomas Canavan Tract and land now or
     6  formerly belonging to G.F. and C.E. Reynolds; thence, north 52
     7  degrees 30 minutes 00 seconds west along said last mentioned
     8  line about 70 feet, more or less, to the easterly right-of-way
     9  line now or formerly the D.L. & W. Railroad; thence along a 09
    10  degree curve in a northeasterly direction along said right-of-
    11  way line about 429 feet, more or less, to a point; thence, along
    12  said line now at formerly D.L. & W. Railroad north 03 degrees 30
    13  minutes 00 seconds east to place of beginning.
    14     Containing 4.15 acres, more or less.
    15  Section 5.  Description of deed restrictions.
    16     The deed restriction to be transferred to the parcel
    17  described in section 4 shall read as follows:
    18     This indenture is given to provide land for recreation,
    19  conservation and historical purposes as said purposes are
    20  defined in the act of June 22, 1964 (Sp.Sess., P.L.131, No.8),
    21  known as the Project 70 Land Acquisition and Borrowing Act.
    22  Section 6.  Effective date.
    23     This act shall take effect immediately.
