AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for 21 general health administration in cities of the third class. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Section 2102(h) of the act of April 9, 1929 25 (P.L.177, No.175), known as The Administrative Code of 1929, is 26 amended to read: 27 Section 2102. General Health Administration.--The Department
1 of Health shall have the power, and its duty shall be: 2 * * * 3 (h) Whenever, in the opinion of the department, conditions 4 exist in any city of the third class, any borough, or any 5 township of the first class, within the Commonwealth, which 6 constitute a menace to the lives and health of the people living 7 outside the corporate limits of such city, borough or township, 8 or, after it be known to the department that any city of the 9 third class, any borough or any township of the first class is 10 without an existing or efficient board of health, to enter and 11 take full charge of and administer the health laws, regulations, 12 and ordinances, of such city, borough or township, and to 13 continue in charge thereof, until the department shall decide 14 that a competent and efficient board of health has been 15 appointed and qualified for such city, borough or township and 16 is ready, able, and willing to assume and carry into effect the 17 duties imposed upon it by law, and to collect all expenses 18 incurred by the department in performing its duties hereunder, 19 as may now or hereafter be provided by law; 20 * * * 21 Section 2.
