                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor, to convey to Emsworth
     3     Borough 7.5 acres of land, more or less, situate in Kilbuck
     4     Township, Allegheny County, Pennsylvania; AUTHORIZING AND      <--
     5     DIRECTING THE DEPARTMENT OF GENERAL SERVICES, WITH THE
     6     APPROVAL OF THE GOVERNOR AND THE DEPARTMENT OF AGRICULTURE,
     7     TO CONVEY TO THE COUNTY OF CHESTER 230.693 ACRES OF LAND,
     8     MORE OR LESS, SITUATE IN NEWLIN AND WEST BRADFORD TOWNSHIPS,
     9     CHESTER COUNTY, PENNSYLVANIA; AUTHORIZING THE DEPARTMENT OF
    10     GENERAL SERVICES, WITH THE APPROVAL OF THE GOVERNOR AND THE
    11     DEPARTMENT OF PUBLIC WELFARE, TO CONVEY TO NORTH PENN
    12     COMPREHENSIVE HEALTH SERVICES 8.7 ACRES OF LAND, MORE OR
    13     LESS, SITUATE IN THE BOROUGH OF BLOSSBURG, TIOGA COUNTY,
    14     PENNSYLVANIA; AUTHORIZING AND DIRECTING THE DEPARTMENT OF
    15     GENERAL SERVICES, WITH THE APPROVAL OF THE GOVERNOR AND THE
    16     DEPARTMENT OF ENVIRONMENTAL RESOURCES, TO CONVEY TO GILBERT
    17     COLLUSSY, LENA M. COLLUSSY, JAMES T. DRESHER AND VIRGINIA M.
    18     DRESHER, A TRACT OF LAND SITUATE IN NORTH SHENANGO TOWNSHIP,
    19     CRAWFORD COUNTY, PENNSYLVANIA, IN EXCHANGE FOR A TRACT OF
    20     LAND IN THE SAME TOWNSHIP, AND FOR OTHER CONSIDERATION; AND
    21     AUTHORIZING AND DIRECTING THE DEPARTMENT OF GENERAL SERVICES,
    22     WITH THE APPROVAL OF THE GOVERNOR AND THE DEPARTMENTS OF
    23     ENVIRONMENTAL RESOURCES AND TRANSPORTATION, TO CONVEY TO THE
    24     MID-STATE REGIONAL AIRPORT AUTHORITY A TRACT OF LAND SITUATE
    25     IN RUSH TOWNSHIP, CENTRE COUNTY, PENNSYLVANIA.

    26     The General Assembly of the Commonwealth of Pennsylvania
    27  hereby enacts as follows:
    28     Section 1.  (A)  The Department of General Services, with the  <--


     1  approval of the Governor, is hereby authorized and directed on
     2  behalf of the Commonwealth of Pennsylvania to grant and convey,
     3  to Emsworth Borough for consideration of one-half of the fair
     4  market value as determined by an independent appraisal and as
     5  approved by the Department of General Services, the following
     6  tract of land situate in Kilbuck Township, Allegheny County,
     7  Pennsylvania, bounded and described as follows:
     8     Beginning at a point located at the intersection of the
     9  boundary line of Emsworth Borough and Kilbuck Township with the
    10  southern right-of-way line of Huntington Avenue (Legislative
    11  Route No.02334); thence south 13 degrees 45 minutes west for a
    12  distance of 257 feet, more or less, to a point on the boundary
    13  line of Emsworth Borough and Kilbuck Township; thence south 27
    14  degrees 15 minutes west for a distance of 259.38 feet to a point
    15  on the boundary line of Emsworth Borough and Kilbuck Township;
    16  thence south 04 degrees 15 minutes west for a distance of 85
    17  feet, more or less, to a point at the intersection of the
    18  boundary line of Emsworth Borough and Kilbuck Township and the
    19  northern right-of-way line of Ohio River Boulevard (Legislative
    20  Route No.652); thence in a northwesterly direction along the
    21  northern right-of-way of Ohio River Boulevard for a distance of
    22  160 feet, more or less, to a point having an arc circle radius
    23  of 11,519.19 feet for a distance of 620 feet to a point; thence
    24  north 13 degrees 04 minutes east for a distance of 255 feet,
    25  more or less, to a point; thence south 76 degrees 56 minutes
    26  east for a distance of 313 feet, more or less, to a point;
    27  thence north 69 degrees 58 minutes east for a distance of 256
    28  feet, more or less, to a point; thence north 13 degrees 04
    29  minutes east for a distance of 100 feet to a point on the
    30  southern right-of-way line of Huntington Avenue (Legislative

     1  Route No.02334); thence in a southeasterly direction on the
     2  southern right-of-way line of Huntington Avenue (Legislative
     3  Route No.02334) along an arc curving to the left having a radius
     4  of 1,094.03 feet for a distance of 296.55 feet, more or less, to
     5  a point and place of beginning.
     6     Containing 7.5 acres, more or less.
     7     Section 2.  (B)  The property is described in drawing number   <--
     8  B-1583, prepared for the Borough of Emsworth on January 14,
     9  1986, by the Senate Engineering Company.
    10     Section 3.  (C)  The conveyance shall be made under and        <--
    11  subject to all easements, servitudes and rights of others,
    12  including, but not confined to, streets, roadways and rights of
    13  any telephone, telegraph, water, electric, sewer, gas or
    14  pipeline companies, as well as under and subject to any
    15  interest, estates or tenancies vested in third persons, whether
    16  or not appearing of record, for any portion of the land or
    17  improvements erected thereon.
    18     Section 4.  (D)  The deed of conveyance shall contain a        <--
    19  clause that the lands conveyed shall be used for recreational
    20  purposes by Emsworth Borough and, if at any time the borough or
    21  its successor in function conveys the property or permits the
    22  property to be used for any purpose other than those specified
    23  in this section, the title to the property shall immediately
    24  revert to and revest in the Commonwealth of Pennsylvania.
    25     Section 5.  (E)  The proceeds of this sale shall be paid into  <--
    26  the State Treasury and deposited in the Capital Facilities
    27  Redemption Fund.
    28     Section 6.  (F)  The deed of conveyance shall be approved as   <--
    29  provided by law and shall be executed by the Secretary of
    30  General Services in the name of the Commonwealth of

     2     Section 7.  (G)  Costs and fees incidental to the conveyance   <--
     3  shall be borne by the grantee.
     4     SECTION 2.  (A)  THE DEPARTMENT OF GENERAL SERVICES, WITH THE  <--
     5  APPROVAL OF THE GOVERNOR AND THE DEPARTMENT OF AGRICULTURE, IS
     6  HEREBY AUTHORIZED AND DIRECTED, ON BEHALF OF THE COMMONWEALTH OF
     7  PENNSYLVANIA, TO GRANT AND CONVEY, FOR A CONSIDERATION OF ONE-
     8  HALF OF THE FAIR MARKET VALUE AS DETERMINED BY AN APPRAISAL,
     9  CONDUCTED BY THE DEPARTMENT OF GENERAL SERVICES, TO THE COUNTY
    10  OF CHESTER THE FOLLOWING TRACT OF LAND SITUATE IN WEST BRADFORD

    24  AGRICULTURAL PURPOSES AND THAT THE EXISTING IMPROVEMENTS UPON
    25  THE LANDS MAY BE RENOVATED AND UTILIZED FOR COUNTY AND LOCAL
    26  GOVERNMENT PROGRAMS AND SERVICES AND, IF AT ANY TIME THE COUNTY
    27  OR ITS SUCCESSOR IN FUNCTION CONVEYS THE PROPERTY OR PERMITS THE
    28  PROPERTY TO BE USED FOR ANY PURPOSE OTHER THAN THOSE SPECIFIED
    29  IN THIS SECTION, THE TITLE TO THE PROPERTY SHALL IMMEDIATELY

    12  MUTUAL PROMISES AND COVENANTS CONTAINED HEREIN, THE PROPERTY
    13  DESCRIBED BELOW, TOGETHER WITH ANY AND ALL BUILDINGS AND
    14  IMPROVEMENTS NOW OR HEREAFTER LOCATED ON OR AT, OR USED IN
