                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor, to convey to Emsworth
     3     Borough and Kilbuck Township, as tenants in common, 7.5 acres
     4     of land, more or less, situate in Kilbuck Township, Allegheny
     5     County, Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the Governor, is hereby authorized and directed on
    10  behalf of the Commonwealth of Pennsylvania to grant and convey,
    11  to Emsworth Borough and Kilbuck Township, as tenants in common,
    12  for consideration of one-half of the fair market value as
    13  determined by an independent appraisal and as approved by the
    14  Department of General Services, the following tract of land
    15  situate in Kilbuck Township, Allegheny County, Pennsylvania,
    16  bounded and described as follows:
    17     Beginning at a point located at the intersection of the
    18  boundary line of Emsworth Borough and Kilbuck Township with the
    19  southern right-of-way line of Huntington Avenue (Legislative

     1  Route No.02334); thence south 13 degrees 45 minutes west for a
     2  distance of 257 feet, more or less, to a point on the boundary
     3  line of Emsworth Borough and Kilbuck Township; thence south 27
     4  degrees 15 minutes west for a distance of 259.38 feet to a point
     5  on the boundary line of Emsworth Borough and Kilbuck Township;
     6  thence south 04 degrees 15 minutes west for a distance of 85
     7  feet, more or less, to a point at the intersection of the
     8  boundary line of Emsworth Borough and Kilbuck Township and the
     9  northern right-of-way line of Ohio River Boulevard (Legislative
    10  Route No.652); thence in a northwesterly direction along the
    11  northern right-of-way of Ohio River Boulevard for a distance of
    12  160 feet, more or less, to a point having an arc circle radius
    13  of 11,519.19 feet for a distance of 620 feet to a point; thence
    14  north 13 degrees 04 minutes east for a distance of 255 feet,
    15  more or less, to a point; thence south 76 degrees 56 minutes
    16  east for a distance of 313 feet, more or less, to a point;
    17  thence north 69 degrees 58 minutes east for a distance of 256
    18  feet, more or less, to a point; thence north 13 degrees 04
    19  minutes east for a distance of 100 feet to a point on the
    20  southern right-of-way line of Huntington Avenue (Legislative
    21  Route No.02334); thence in a southeasterly direction on the
    22  southern right-of-way line of Huntington Avenue (Legislative
    23  Route No.02334) along an arc curving to the left having a radius
    24  of 1,094.03 feet for a distance of 296.55 feet, more or less, to
    25  a point and place of beginning.
    26     Containing 7.5 acres, more or less.
    27     Section 2.  The property is described in drawing number B-
    28  1583, prepared for the Borough of Emsworth on January 14, 1986,
    29  by the Senate Engineering Company.
    30     Section 3.  The conveyance shall be made under and subject to

     1  all easements, servitudes and rights of others, including, but
     2  not confined to, streets, roadways and rights of any telephone,
     3  telegraph, water, electric, sewer, gas or pipeline companies, as
     4  well as under and subject to any interest, estates or tenancies
     5  vested in third persons, whether or not appearing of record, for
     6  any portion of the land or improvements erected thereon.
     7     Section 4.  The deed of conveyance shall contain a clause
     8  that the lands conveyed shall be used for recreational purposes
     9  by Emsworth Borough and Kilbuck Township and, if at any time the
    10  borough or township or their successors in function convey the
    11  property or permit the property to be used for any purpose other
    12  than those specified in this section, the title to the property
    13  shall immediately revert to and revest in the Commonwealth of
    14  Pennsylvania.
    15     Section 5.  The proceeds of this sale shall be paid into the
    16  State Treasury and deposited in the Capital Facilities
    17  Redemption Fund.
    18     Section 6.  The deed of conveyance shall be approved as
    19  provided by law and shall be executed by the Secretary of
    20  General Services in the name of the Commonwealth of
    21  Pennsylvania.
    22     Section 7.  Costs and fees incidental to the conveyance shall
    23  be borne by the grantees.
    24     Section 8.  This act shall take effect immediately.
