           AMENDED, JUNE 30, 1986

                                     AN ACT

     1  Amending the act of July 1, 1978 (P.L.584, No.109), entitled "An
     2     act establishing an agency to create the linkage necessary
     3     for the planning of an economic development system for
     4     Pennsylvania, and making an appropriation," further providing
     5     for powers and duties of council, and for the operation and
     6     functions of area labor management committees.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 6 of the act of July 1, 1978 (P.L.584,
    10  No.109), known as the Milrite Act, is amended to read:
    11  Section 6.  Powers and duties of council.
    12         (1)  Undertake research and investigation relating to the
    13     promotion of the industrial potential of Pennsylvania.
    14         (2)  Create plans for economic revitalization of
    15     Commonwealth industries.
    16         (3)  Recommend implementation procedures for all plans,

     1     maximizing existing mechanisms with proven ability to
     2     accomplish tasks, linkages among current programs, business,
     3     labor and government insights into practicality and
     4     workability of suggested approaches.
     5         (4)  Encourage and stimulate cooperation and coordination
     6     among Federal, State and local programs.
     7         (5)  Recommend structural changes and updating of
     8     economic delivery tools of State Government to the Governor
     9     and General Assembly.
    10         (6)  Draw upon labor, management and government
    11     participants to promulgate plans and implement procedures.
    12         (7)  Recommend organizational structure and participants
    13     particularly suited to local needs and conditions.
    14         (8)  Undertake research, including the hiring of
    15     consultants, into the cost of doing business in this
    16     Commonwealth, including recommendations for changes and
    17     estimates of future costs, with comparative analysis of both
    18     intrastate and intrastate costs.
    19         (9)  Undertake research, including the hiring of
    20     consultants, to determine if the Commonwealth can more
    21     effectively use its mediation services to discourage, and
    22     shorten the duration of, labor-management disputes.
    23         [(8)] (10)  The council shall have the power to:
    24             (i)  Enter into contracts.
    25             (ii)  Appoint, fix compensation of, and prescribe
    26         duties of an executive director, secretary and such other
    27         personnel as the council deems necessary to accomplish
    28         the purposes of this act. The council shall be able to     <--
    29         appoint or discharge employees without being required to
    30         make a request of any executive agency. It is the intent

     1         of this provision that the council can function
     2         effectively only as an agency independent of any other
     3         branch of government.
     4             (iii)  Retain counsel.
     5             (iv)  Accept grants from public and private sources.
     6             (v)  Borrow money and issue obligations, secured or
     7         unsecured, to acquire, hold, own and pledge or dispose of
     8         funds, money, securities and other property, real or
     9         personal, tangible or intangible to the extent necessary
    10         to carry out the purposes of this act.
    11             (vi)  Adopt and promulgate rules and regulations
    12         necessary to accomplish the provisions of this act.
    13  Agencies of the Commonwealth shall provide their full
    14  cooperation to research conducted by the council, including, but
    15  not limited to, the provision of information necessary for
    16  conducting research under paragraphs (8) and (9).
    17     Section 2.  Section 6.1 of the act, added May 31, 1984
    18  (P.L.378, No.77), is amended to read:
    19  Section 6.1.  Area labor management committees.
    20     (a)  The council shall establish standards and criteria for
    21  the selection of area labor management committees to be assisted
    22  by [[matching]] grants under subsection (c), solicit proposals    <--
    23  from area labor management committees, review and evaluate the
    24  relative merits of such proposals and select those proposals for
    25  funding which would best meet the standards and criteria
    26  established by the council.
    27     (b)  The council may use a reasonable amount of any
    28  appropriation for grants to area labor management committees to
    29  hire staff and provide support for area labor management
    30  committees and for carrying out the purposes specified in

     1  subsection (a). Funds shall be used for staff and other expenses
     2  necessary to perform out-reach functions to those areas of the
     3  Commonwealth not served by area labor management committees.
     4     (c)  The council shall designate the area labor management
     5  committees which are entitled to receive [[matching]] grants      <--
     6  pursuant to subsection (a). Funds appropriated to the Department
     7  of Commerce for grants to area labor management committees shall
     8  be made to those committees, in amounts and under conditions
     9  specified by the council, and under the following conditions:
    10         (1)  The grant shall be matched with as much non-State
    11     funds as possible, within the overall goal of attempting to
    12     establish and maintain as many area labor management
    13     committees as possible.
    14         (2)  While the highest priority for these funds shall be
    15     for the establishment of new area labor management
    16     committees, the council shall make use of the money available
    17     to it for the grants to ensure the continued existence and
    18     expansion of existing area labor management committees,
    19     including the provisions of technical assistance and
    20     nonmatching grants.
    21     (d)  The council shall report annually to the chairman and
    22  minority chairman of the Senate Committee on Appropriations, the
    23  chairman and minority chairman of the House Committee on
    24  Appropriations, the chairman and minority chairman of the Senate
    25  Committee on Labor and Industry and the chairman and minority
    26  chairman of the House Committee on Labor Relations, the
    27  accomplishments and specific expenditures of each area labor
    28  management committee funded under subsections (a) and (c)
    29  including, but not limited to, salaries, rent, contracts and
    30  other operational costs.
