                                     AN ACT

     1  Requiring the Department of Health to conduct tests of certain
     2     persons operating emissions testing machines.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Emissions
     7  Machine Operator's Health Test Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of Health of the Commonwealth.
    13     "Emissions testing machines."  Equipment or mechanical
    14  devices which are capable of performing an analysis of the
    15  exhaust fumes from motor vehicles to determine the level and
    16  chemical content of motor vehicle exhaust fumes.
    17     "Operator."  An individual who operates an emissions testing


     1  machine for a period of five hours or more each day over a
     2  period of five days every work week.
     3  Section 3.  Imposition of testing requirement.
     4     (a)  Requirements.--The department shall, within 60 days of
     5  the effective date of this act, begin to conduct a series of
     6  health tests on operators of emissions testing machines to
     7  determine if any health hazard results from the operation of an
     8  emissions testing machine.
     9     (b)  Limitation.--The department shall conduct the series of
    10  health tests on a minimum of 5% of the operators of emissions
    11  testing machines selected on a Statewide basis from those areas
    12  where mandatory emissions inspection programs are in effect.
    13     (c)  Report and completion of tests.--The conduct of the
    14  health tests and the results from those tests shall be reported
    15  to the Governor and the General Assembly no later than one year
    16  after the effective date of this act.
    17  Section 4.  Effective date.
    18     This act shall take effect in 60 days.
