                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," providing for special absentee ballots.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  The act of act of June 3, 1937 (P.L.1333,
    15  No.320), known as the Pennsylvania Election Code, is amended by
    16  adding a section to read:
    17     Section 1305.1.  Special Absentee Ballots.--(a)
    18  Notwithstanding any other provision of this act, a special
    19  absentee voter who qualifies under this section may apply for a

     1  special absentee ballot. An application may be made to the
     2  county board of electors within ninety (90) days of the date of
     3  the election.
     4     (b)  If a special absentee voter submits an application
     5  containing a statement that, due to military service, he will be
     6  unable to return his ballot within the prescribed time if it is
     7  mailed at the time specified in section 1305, the county board
     8  shall send to the applicant a ballot in a form prescribed by the
     9  Secretary of the Commonwealth.
    10     (c)  The county board of elections shall send with the ballot
    11  a list of all candidates who have qualified for the ballot at
    12  least forty-five (45) days before the election and a list of all
    13  questions which are submitted to the voters. The voter shall be
    14  entitled to write in the name of a specific candidate. Any name
    15  written upon a ballot under this subsection shall be counted for
    16  the office.
    17     (d)  Except as otherwise provided in this section, the
    18  provisions of this act relating to absentee ballots shall apply
    19  to special absentee ballots.
    20     Section 2.  This act shall take effect in 60 days.
