                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," further providing for
     5     penalties for damage to or theft of grave markers and flag
     6     holders.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 2113(l) of the act of July 28, 1953
    10  (P.L.723, No.230), known as the Second Class County Code, is
    11  amended to read:
    12     Section 2113.  Markers on Graves; Headstones.--* * *
    13     (l)  Any person who shall wilfully, maliciously or carelessly
    14  destroy, mutilate, remove or deface any grave marker or
    15  headstone placed or erected under the provisions of this section
    16  shall be guilty of [a misdemeanor, and, upon conviction thereof,
    17  shall be sentenced to pay a fine not to exceed five hundred
    18  dollars ($500) or suffer imprisonment not to exceed two years,
    19  or both] the grade of offense in relation to the dollar amount


     1  of the theft or damage done in accordance with l8 Pa.C.S. § 3903
     2  (relating to grading of theft offenses).
     3     Section 2.  This act shall take effect in 60 days.
