                                     AN ACT

     1  Amending the act of August 24, 1963 (P.L.1132, No.484), entitled
     2     "An act providing for the creation, establishment and
     3     operation of community colleges, granting certain powers to
     4     the State Board of Education, the Council of Higher Education
     5     and the Department of Public Instruction; authorizing school
     6     districts, county boards of school directors and
     7     municipalities to sponsor community colleges; authorizing
     8     school districts and municipalities to levy certain taxes;
     9     providing for reimbursements by the Commonwealth of certain
    10     costs and expenses, and making an appropriation," further
    11     providing for payments by the Commonwealth.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 14(b) of the act of August 24, 1963
    15  (P.L.1132, No.484), known as the Community College Act of 1963,


     1  amended October 26, 1983 (P.L.174, No.44), is amended to read:
     2     Section 14.  Financial Program; Reimbursement or Payments.--*
     3  * *
     4     (b)  (1)  The Commonwealth shall pay to a community college
     5  on behalf of the sponsor on account of its operating costs
     6  during the fiscal year from funds appropriated for that purpose
     7  an amount equal to one-third of such college's approved
     8  operating costs not to exceed one thousand five hundred dollars
     9  ($1,500) for fiscal years up to and including 1979-1980, one
    10  thousand eight hundred dollars ($1,800) for fiscal years 1980-
    11  1981, 1981-1982 and 1982-1983 and two thousand four hundred
    12  dollars ($2,400) for fiscal year 1983-1984 and thereafter per
    13  student multiplied by the number of equivalent full-time
    14  students determined by an audit to be made in a manner
    15  prescribed by the State Board of Education. [In addition the
    16  Commonwealth shall pay to a community college on account of its
    17  operating costs for all equivalent full-time students enrolled
    18  in two-year or less than two-year terminal non-liberal arts
    19  programs, a sum of three hundred dollars ($300) for each such
    20  equivalent full-time student. The Secretary of Education shall
    21  have the power and his duty shall be to designate the programs
    22  of study which conform to the intent of this act.]
    23     (1.1)  In addition the Commonwealth shall pay to a community
    24  college, on account of its operating costs for all equivalent
    25  full-time students enrolled in the following categories of two-
    26  year or less than two-year occupational or technical programs, a
    27  stipend as follows:
    28     (i)  One thousand one hundred dollars ($1,100) per full-time
    29  equivalent student enrolled in programs designated as Statewide
    30  Programs and offered at limited locations due to their limited

     1  but continuing demand.
     2     (ii)  One thousand dollars ($1,000) per full-time equivalent
     3  student enrolled in programs designated as Allied Health
     4  Programs.
     5     (iii)  Nine hundred dollars ($900) per full-time equivalent
     6  student enrolled in programs designated as Advanced Technology
     7  Programs.
     8     (iv)  Seven hundred dollars ($700) per full-time equivalent
     9  student enrolled in programs designated as Critical Shortage
    10  Programs.
    11     (v)  Three hundred dollars ($300) per full-time equivalent
    12  student enrolled in other occupational or technical programs.
    13     (1.2)  The Secretary of Education shall establish criteria to
    14  be used to determine eligibility of programs for each of the
    15  above stipend categories and shall annually approve programs for
    16  funding in the following fiscal year according to these
    17  criteria.
    18     (1.3)  Each community college shall maintain such accounting
    19  and student attendance records on generally accepted principles
    20  and standards as will lend themselves to satisfactory audit. The
    21  Commonwealth shall pay to a community college on behalf of the
    22  sponsor on account of its capital expenses an amount equal to
    23  one-half of such college's annual capital expenses from funds
    24  appropriated for that purpose to the extent that said capital
    25  expenses have been approved as herein provided.
    26     (2)  For purposes of determining Commonwealth reimbursement
    27  of operating costs, Federally funded expenditures for those
    28  programs in which the Commonwealth participates in the cost
    29  shall be deducted from total operating expenditures to determine
    30  net reimbursable operating costs.
