                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the occupancy of trailing
     3     vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 102 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a definition to read:
     8  § 102.  Definitions.
     9     Subject to additional definitions contained in subsequent
    10  provisions of this title which are applicable to specific
    11  provisions of this title, the following words and phrases when
    12  used in this title shall have, unless the context clearly
    13  indicates otherwise, the meanings given to them in this section:

    15     "Trailing vehicle."  A vehicle that cannot be steered by an
    16  occupant of the vehicle, which vehicle is being drawn behind a
    17  motor vehicle.

     1     Section 2.  Section 3706 of Title 75 is amended to read:
     2  § 3706.  Riding in [house trailers, mobile homes or boats on
     3             trailers] trailing vehicles.
     4     (a)  General rule.--No person [or persons] shall occupy a
     5  [house trailer, mobile home or boat on a trailer while it is
     6  being moved upon] trailing vehicle on a highway.
     7     (b)  Towing prohibited.--No person shall tow on a highway a
     8  [house trailer, mobile home or boat on a trailer] trailing
     9  vehicle occupied by a passenger [or passengers].
    10     (c)  Exception for certain semitrailers.--A semitrailer which
    11  is attached to a truck in an articulating manner by means of a
    12  fifth wheel semitrailer coupling device attached to the carrying
    13  compartment of the truck may be occupied by a passenger or
    14  passengers. The coupling device shall have a two-inch or larger
    15  kingpin. All windows shall have safety glass. Some means of
    16  electrical or electronic communications approved by the
    17  department is required between the cab of the truck and the
    18  semitrailer.
    19     (d)  Exception for other vehicles.--Subsections (a) and (b)
    20  do not apply to trailing vehicles drawn by implements of
    21  husbandry or trailers approved by the Public Utility Commission
    22  for carrying passengers.
    23     Section 3.  This act shall take effect in 60 days.
