                                     AN ACT

     1  Establishing the fees to be charged and collected by the clerk
     2     of courts in second class A counties only.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Fees charged and collected.
     6     The fees to be charged and collected by the clerks of courts
     7  in second class A counties only shall be as follows:
     8         (1)  A fee of not less than $35, nor more than $150, for
     9     all proceedings in all misdemeanor and felony cases disposed
    10     of at any time during or after trial.
    11         (2)  A fee of not less than $20, nor more than $125, for
    12     all proceedings in all misdemeanor and felony cases disposed
    13     of before trial.
    14         (3)  The fees referred to in paragraphs (1) and (2) shall
    15     be set annually by the clerk of courts on or before January 1
    16     of each year except in 1985 when they shall be set within 20
    17     days and, when added to other fees charged, shall bear a


     1     reasonable relationship to the sum sufficient to maintain and
     2     operate the office of clerk of courts and that part of the
     3     court administration's expenses attributed to those functions
     4     required to process criminal actions as well as a reasonable
     5     share of the cost of maintaining a public law library, which
     6     cost shall be determined by the commissioners.
     7         (4)  A fee of $15 for all proceedings in summary matters.
     8         (5)  A fee of $5 for all certifications.
     9         (6)  A fee of $10 for all other matters filed in the
    10     office and for all reports prepared by the clerk, except that
    11     no fee shall be charged for filing township and borough audit
    12     reports or transcripts received which indicate a final
    13     disposition by the district justice.
    14         (7)  A fee of $25 for the filing of an appeal from a
    15     summary conviction before a district justice.
    16         (8)  A fee of $30 for an appeal from the court of common
    17     pleas to an appellate court.
    18         (9)  A fee of 3¢ per dollar for the first $1,000 and 1¢
    19     per dollar for each additional $1,000, or fraction thereof,
    20     for the handling of money paid into court.
    21  Section 2.  Repeal.
    22     The act of June 18, 1982 (P.L.547, No.158), entitled "An act
    23  establishing the fees to be charged and collected by the clerk
    24  of courts in second, second class A, third, fourth, fifth,
    25  sixth, seventh and eighth class counties and home rule
    26  counties," is repealed insofar as it relates to second class A
    27  counties only.
    28  Section 3.  Effective date.
    29     This act shall take effect immediately.
