AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," providing for minimum salaries, a 6 State salary supplement and for State subsidies to pay for 7 the minimum salaries and salary supplement. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. The act of March 10, 1949 (P.L.30, No.14), known 11 as the Public School Code of 1949, is amended by adding sections 12 to read: 13 Section 1142.1. Minimum Salary.--For the 1985-1986 school 14 year and each school year thereafter, no professional or 15 temporary professional employe below the first level of 16 supervision, as defined in section 301 of the act of July 23, 17 1970 (P.L.563, No.195), known as the Public Employe Relations 18 Act, shall receive a salary of less than eighteen thousand five
1 hundred dollars ($18,500). Each school entity shall adjust its 2 salary schedule or other salary system to reflect at least the 3 eighteen thousand five hundred dollars ($18,500) minimum salary. 4 The adjustment to the schedule or system shall be made effective 5 upon the expiration of its current collective bargaining 6 agreement, but in no case later than July 1, 1988. For the 7 purpose of this section and section 1142.2, school entity shall 8 include school districts, intermediate units, area vocational- 9 technical schools, State-owned schools, prison schools, youth 10 development centers and community colleges. 11 Section 1142.2. State Salary Supplement.--For the 1985-1986 12 school year and each school year thereafter, any professional 13 employe or temporary professional employe receiving sixteen 14 thousand five hundred one dollars ($16,501) or more on the 15 school entity salary schedule or other salary system shall 16 receive a two thousand dollar ($2,000) State salary supplement. 17 The salary supplement shall be in addition to the salaries set 18 forth in the school entity salary schedule or salary system. 19 Section 2502.13. State Subsidy on Account of Salary 20 Supplement.--(a) For the 1985-1986 school year and each school 21 year thereafter, the Commonwealth shall pay to school districts, 22 intermediate units, State-owned schools, community colleges, and 23 the Department of Education on behalf of its prison schools and 24 youth development center employes, on account of salaries of all 25 professional or temporary professional employes below the first 26 level of supervision, as defined in section 301 of the act of 27 July 23, 1970 (P.L.563, No.195), known as the Public Employe 28 Relations Act, a salary supplement of two thousand dollars 29 ($2,000) times the number of said employes. Each entity shall 30 certify the number of employes and report the information on 19850H0408B0462 - 2 -
1 forms prepared by the Department of Education by November 1, 2 1985, and each November 1 thereafter. Upon certification of the 3 number of said employes below the level of first level 4 supervisor, the Secretary of Education shall certify to each 5 entity the amount of its salary supplement entitlement by March 6 1, 1986, and each March 1 thereafter. A payment equal to one- 7 half of the entitlement shall be made in April 1986 and the 8 second half in June 1986 and each April and June each school 9 year thereafter. 10 (b) In addition to the amount provided in subsection (a), 11 each school district, intermediate unit, State-owned school, the 12 Department of Education for its prison school employes and youth 13 development center employes, and community colleges, so 14 entitled, shall receive from the Commonwealth during the 1985- 15 1986 school year and each school year thereafter, an amount 16 equal to the sum of the amounts by which the actual salary 17 provided for each professional employe and temporary 18 professional employe below the first level of supervision, as 19 defined in section 301 of the Public Employe Relations Act, 20 under the school entity salary schedule or salary system adopted 21 for the 1985-1986 school year, is less than eighteen thousand 22 five hundred dollars ($18,500). In cases where a professional or 23 temporary professional employe below the first level of 24 supervision is employed for less than a school year, a 25 proportionate amount shall be determined and paid to the school 26 entity on the basis of an eighteen thousand five hundred dollar 27 ($18,500) minimum salary and the 1985-1986 local entity salary 28 schedule or salary system. 29 Section 2.
