AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for handicapped and disabled 3 veterans' parking; and providing penalties. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 3354(d) and (e) of Title 75 of the 7 Pennsylvania Consolidated Statutes are amended to read: 8 § 3354. Additional parking regulations. 9 * * * 10 (d) Handicapped persons and disabled veterans.-- 11 (1) When a motor vehicle bearing registration plates or 12 displaying a placard issued to handicapped persons or 13 disabled veterans as prescribed in this title is being 14 operated by or for the transportation of the handicapped 15 person or disabled veteran, the driver shall be relieved of 16 any liability for parking for a period of 60 minutes in
1 excess of the legal parking period permitted by local 2 authorities except where local ordinances or police 3 regulations provide for the accommodation of heavy traffic 4 during morning, afternoon or evening hours. 5 (2) At the request of any handicapped person or disabled 6 veteran, local authorities may erect on the highway as close 7 as possible to their place of residence a sign or signs 8 indicating that that place is reserved for a handicapped 9 person or disabled veteran, that no parking is allowed there 10 by others, and that any unauthorized person parking there 11 shall be subject to a fine. 12 (3) Except for persons parking vehicles lawfully bearing 13 registration plates or parking placards issued to handicapped 14 persons or disabled veterans, no person shall park a vehicle 15 on public or private property reserved for a handicapped 16 person or disabled veteran which property has been so posted 17 in accordance with departmental regulations. 18 (4) Churches, hotels, hospitals, nursing homes, schools, 19 commercial stores, theaters, sports arenas, restaurants, 20 airports, SHOPPING CENTERS, OTHER PUBLIC BUILDINGS, and <-- 21 apartments with interior dining facilities open to the 22 public, maintaining parking lots WITH 15 TO 50 PARKING SPACES <-- 23 for the use of their customers, shall erect and maintain at 24 their own expense at least one handicapped parking space 25 which shall be marked by a sign which shall be erected and 26 maintained in accordance with departmental regulations. 27 PARKING LOTS WITH MORE THAN 50 PARKING SPACES WHICH ARE <-- 28 MAINTAINED BY THESE ENTITIES FOR THEIR CUSTOMERS SHALL HAVE 29 4% OF THE PARKING SPACES SET ASIDE AND MARKED FOR USE BY 30 HANDICAPPED PERSONS. 19850H0291B0912 - 2 -
1 (e) Penalty.--Any person violating subsection (a), (b) or 2 (d)(1), (2) or (3) is guilty of a summary offense and shall, 3 upon conviction, be sentenced to pay a fine of not more than 4 $15. Any person violating subsection (d)(4) is guilty of a 5 summary offense and shall, upon conviction, be sentenced to pay 6 a fine of $50. 7 Section 2. This act shall take effect in 90 days.
