AN ACT
1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2 act to consolidate, editorially revise, and codify the public
3 welfare laws of the Commonwealth," providing that recipients
4 of medical assistance shall not be required to copay for
5 compensable services; and negating a proposed regulation
6 relating to medical assistance.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of June 13, 1967 (P.L.31, No.21), known
10 as the Public Welfare Code, is amended by adding a section to
11 read:
12 Section 443.7. Copayments for Medical Assistance Services
13 Prohibited.--Medical assistance payments to providers on behalf
14 of eligible persons for compensable services shall be made in
15 full by the department, without any copayment being required to
16 be paid by the recipient of the services.
17 Section 2. The Department of Public Welfare's proposed
18 medical assistance regulation amending 55 Pa. Code § 1101.63
19 (relating to payment in full), published on March 17, 1984 in
1 volume 14, number 11 of the Pennsylvania Bulletin, shall not be
2 promulgated, or if promulgated shall be null and void.
3 Section 3. This act shall take effect immediately.
