        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           NOVEMBER 26, 1984

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," FURTHER PROVIDING FOR TEACHER          <--
     6     CERTIFICATION REQUIREMENTS.; AND providing for the definition  <--
     7     of "pupil instruction time"; and prohibiting certain persons
     8     from being employed. "PUPIL INSTRUCTION TIME."                 <--

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known   <--
    12  as the Public School Code of 1949, is amended by adding sections
    13  to read:
    14     Section 1215.  Conflicts of Interest.--No person who is a
    15  board member of any school district which participates in the
    16  funding of any vocational-technical school or intermediate unit
    17  shall be eligible to be employed by such vocational-technical
    18  school or intermediate unit as a professional employe or as a
    19  nonprofessional employe.


     1     SECTION 1.  SECTION 1205 OF THE ACT OF MARCH 10, 1949          <--
     2  (P.L.30, NO.14), KNOWN AS THE PUBLIC SCHOOL CODE OF 1949,
     3  AMENDED JULY 22, 1970 (P.L.540, NO.183), IS AMENDED TO READ:
     4     SECTION 1205.  ISSUING PERMANENT COLLEGE CERTIFICATES.--THE
     5  [SUPERINTENDENT OF PUBLIC INSTRUCTION] SECRETARY OF EDUCATION
     6  SHALL ISSUE A PERMANENT COLLEGE CERTIFICATE TO EVERY GRADUATE OF
     7  AN APPROVED COLLEGE OR UNIVERSITY, AND OF SUCH DEPARTMENTS
     8  THEREIN AS ARE APPROVED BY HIM, WHEN SUCH GRADUATE FURNISHES
     9  SATISFACTORY EVIDENCE OF GOOD MORAL CHARACTER AND SUCCESSFUL
    10  EXPERIENCE OF THREE YEARS' TEACHING ON A PROVISIONAL COLLEGE
    11  CERTIFICATE IN APPROVED ELEMENTARY OR SECONDARY SCHOOLS, IN
    12  PRIVATE INSTITUTIONS FROM WHICH THE DEPARTMENT OF [PUBLIC
    13  INSTRUCTION] EDUCATION PURCHASES SERVICES ON A TUITION BASIS,
    14  AND IN STATE-AIDED AND STATE-OWNED SECONDARY SCHOOLS, AND HAS
    15  COMPLETED BY THE END OF THE SIXTH YEAR OF TEACHING SUCH WORK IN
    16  EDUCATION AS MAY BE REQUIRED DURING THE SIX-YEAR PERIOD BY THE
    17  STANDARDS OR REGULATIONS OF THE STATE BOARD OF EDUCATION. SUCH
    18  WORK IN EDUCATION SHALL NOT EXCEED THAT REQUIRED AS OF THE TIME
    19  OF GRADUATION OF SUCH GRADUATES FROM COLLEGES OR UNIVERSITIES
    20  APPROVED BY THE STATE BOARD OF EDUCATION. SUCH CERTIFICATES
    21  SHALL ENTITLE ITS HOLDER TO TEACH WITHOUT FURTHER EXAMINATION.
    22     SECTION 2.  THE ACT IS AMENDED BY ADDING A SECTION TO READ:    <--
    23     Section 1511.1 1511.2.  Definition of Pupil Instruction        <--
    24  Time.--When used in this act, the following words and phrases
    25  shall have the following meanings:
    26     (1)  "Pupil instruction time" means time spent in the school
    27  program and related activities. In addition to the prescribed
    28  courses and instruction, such activities include:
    29     (i)  Clubs, with an academic orientation, student councils
    30  and similar activities which have an academic bearing.

     1     (ii)  School, group or class educational trips, if
     2  accompanied by a certificated school employe.
     3     (iii)  For pupils in graduating classes, not more than three
     4  (3) days for graduation preparation under the supervision of
     5  certificated school employes.
     6     (iv)  Civil defense, fire and other similar drills.
     7     (v)  Opening exercises, homeroom periods and supervised study
     8  halls.
     9     (vi)  Early dismissal and delayed opening due to inclement
    10  weather.
    11     (2)  Pupil instruction time shall not include lunch periods,
    12  recess, early dismissal before a holiday, celebrations, picnics,
    13  hunting, fishing, harvesting crops, or similar activities and
    14  teachers meetings, conferences, conventions, or similar
    15  activities.
    16     SECTION 3 2.  THE DEPARTMENT OF EDUCATION SHALL RECOMMEND TO   <--
    17  THE GENERAL ASSEMBLY, ON OR BEFORE APRIL 1, 1985, ITS PROPOSALS
    18  FOR THE CONTINUING EDUCATION REQUIREMENTS OF ALL PROFESSIONAL
    19  SCHOOL EMPLOYEES.
    20     Section 2 4 3.  This act shall take effect immediately.        <--
