        AS AMENDED ON SECOND CONSIDERATION, JUNE 26, 1984

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for the definition of
     6     "pupil instruction time." TIME"; AND PROHIBITING CERTAIN       <--
     7     PERSONS FROM BEING EMPLOYED.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a         <--
    12  section SECTIONS to read:                                         <--
    13     SECTION 1215.  CONFLICTS OF INTEREST.--NO PERSON WHO IS A      <--
    14  BOARD MEMBER OF ANY SCHOOL DISTRICT WHICH PARTICIPATES IN THE
    15  FUNDING OF ANY VOCATIONAL-TECHNICAL SCHOOL OR INTERMEDIATE UNIT
    16  SHALL BE ELIGIBLE TO BE EMPLOYED BY SUCH VOCATIONAL-TECHNICAL
    17  SCHOOL OR INTERMEDIATE UNIT AS A PROFESSIONAL EMPLOYE OR AS A
    18  NONPROFESSIONAL EMPLOYE.
    19     Section 1511.1.  Definition of Pupil Instruction Time.--When
    20  used in this act the following words and phrase shall have the

     1  following meanings:
     2     (1)  "Pupil instruction time" means time spent in the school
     3  program and related activities. In addition to the prescribed
     4  courses and instruction, such activities include:
     5     (i)  Clubs, with an academic orientation, student councils
     6  and similar activities which have an academic bearing.
     7     (ii)  School, group or class educational trips, if
     8  accompanied by a certificated school employe.
     9     (iii)  For pupils in graduating classes, not more than three
    10  (3) days for graduation preparation under the supervision of
    11  certificated school employes.
    12     (iv)  Civil defense, fire and other similar drills.
    13     (v)  Opening exercises, homeroom periods and supervised study
    14  halls.
    15     (vi)  Early dismissal and delayed opening due to inclement
    16  weather.
    17     (2)  Pupil instruction time shall not include lunch periods,
    18  recess, early dismissal before a holiday, celebrations, picnics,
    19  hunting, fishing, harvesting crops, or similar activities and
    20  teachers meetings, conferences, conventions, or similar
    21  activities.
    22     Section 2.  This act shall take effect immediately.
