        SENATOR TILGHMAN, APPROPRIATIONS, RE-REPORTED AS AMENDED,
           MAY 14, 1984

                                     AN ACT

     1  Amending the act of July 15, 1983 (P.L.596, No.3A) entitled, "An
     2     act making an appropriation from the State Employees'
     3     Retirement Fund to provide for expenses of the State
     4     Employees' Retirement Board for the fiscal year July 1, 1983
     5     to June 30, 1984 and for the payment of bills incurred and
     6     remaining unpaid at the close of the fiscal year ending June
     7     30, 1983," providing an additional appropriation; and adding
     8     provisions relating to audits.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 1 of the act of July 15, 1983 (P.L.596,
    12  No.3A) entitled, "An act making an appropriation from the State
    13  Employees' Retirement Fund to provide for expenses of the State
    14  Employees' Retirement Board for the fiscal year July 1, 1983 to
    15  June 30, 1984 and for the payment of bills incurred and
    16  remaining unpaid at the close of the fiscal year ending June 30,
    17  1983," is amended to read:
    18     Section 1.  (a)  The sum of [$3,437,000] $3,754,000, or as     <--
    19  much thereof as may be necessary, is hereby specifically
    20  appropriated from the State Employees' Retirement Fund to the

     1  State Employees' Retirement Board for the fiscal year beginning
     2  July 1, 1983 and for the payment of bills incurred and remaining
     3  unpaid at the close of the fiscal year ending June 30, 1983 for
     4  the payment of all salaries, wages and other compensation and
     5  travel expenses of the employees and members of the State
     6  Employees' Retirement Board, for contractual services and other
     7  expenses necessary for the proper conduct of the duties,
     8  functions and activities of the board AND THE DISCHARGE OF ITS    <--
     9  RESPONSIBILITIES and for the payment of bills incurred and
    10  remaining unpaid at the close of the fiscal year ending June 30,
    11  1983.
    12     (b)  The sum of $317,000, or as much thereof as may be         <--
    13  necessary, is hereby specifically appropriated from the State
    14  Employees' Retirement Fund to the State Employees' Retirement
    15  Board for fiscal year July 1, 1983 to June 30, 1984 for attorney
    16  fees payable in accordance with a consent decree and court order
    17  concerning the McKenna-Weir and Catania cases.
    18     Section 2.  When an internal control and investment
    19  performance audit of the State Employees' Retirement System is
    20  required by the Auditor General in a fiscal year in which the
    21  expense of such an audit has not been budgeted by the State
    22  Employees' Retirement Board, the expense of the audit shall be
    23  borne by the Department of the Auditor General, and the Auditor
    24  General shall be required to request from and justify to the
    25  General Assembly a special appropriation to the Department of
    26  the Auditor General out of the General Fund for that purpose.
    27     Section 3.  The provisions of section 2 shall be retroactive
    28  to July 1, 1983.
    29     Section 4.  This act shall take effect immediately.
