        AS REPORTED FROM COMMITTEE ON CONSUMER AFFAIRS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, NOVEMBER 21, 1984

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for an offense relating to
     3     falsification.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 4904.1.  Falsification to Commonwealth agencies and political
     9             subdivisions.
    10     (a)  Offense generally.--An individual commits a felony of     <--
    11  the second degree if, during the occurrence of a disaster
    12  emergency which is declared by the appropriate authority as
    13  provided for in 35 Pa.C.S. Part V (relating to emergency
    14  management services), the individual knowingly provides false
    15  information related to the disaster emergency to a Commonwealth
    16  agency or political subdivision.
    17     (b)  Offense relating to power generating facilities.--An

     1  individual commits a felony of the second MISDEMEANOR OF THE      <--
     2  FIRST degree if the individual, WHO IS AN OFFICIAL SPOKESMAN OF   <--
     3  A UTILITY DURING AN OCCURRENCE OF A DISASTER EMERGENCY DECLARED
     4  BY THE APPROPRIATE AUTHORITY AS PROVIDED FOR IN 35 PA.C.S. PART
     5  V (RELATING TO EMERGENCY MANAGEMENT SERVICES), knowingly
     6  provides false information to any agency of the Federal or State
     7  government relating to or regarding any aspect of the operation
     8  of a power generating facility UTILITY which may adversely        <--
     9  affect the health, welfare or safety of the residents of this
    10  Commonwealth.
    11     (c)  Penalty.--An individual who is guilty of violating the    <--
    12  provisions of subsection (a) or (b) shall be sentenced to pay a
    13  fine of not less than $10,000 or to undergo imprisonment for not
    14  less than six years, or both.
    15  Section 2.  Effective date.
    16     This act shall take effect in 60 days.
