AN ACT
1 Authorizing the indebtedness, with the approval of the electors,
2 of $90,000,000 for the repair, rehabilitation, development
3 and acquisition of land and facilities for community services
4 and, public recreational purposes AND PUBLIC ZOOS. <--
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Incurring indebtedness.
8 The question of incurring indebtedness of $90,000,000 for
9 rehabilitation of deteriorated park and recreation facilities
10 AND PUBLIC ZOOS, for acquisition and development of land to <--
11 preserve wildlife habitats AND PUBLIC ZOOS, complete public <--
12 recreation areas and develop fishing and boating access areas
13 and for the rehabilitation and the conversion of surplus schools
14 and other public buildings OR NEW CONSTRUCTION to house <--
15 recreation programs, HISTORICAL AND NATURAL INTERPRETIVE <--
16 PROGRAMS and community services shall be submitted to the
17 electors at the next primary, municipal or general election
1 following enactment of this act. 2 Section 2. Certify question. 3 The Secretary of the Commonwealth shall forthwith certify the 4 question to the county boards of election. 5 Section 3. Question to electorate. 6 The question shall be in substantially the following form: 7 Do you favor the incurring of indebtedness by the 8 Commonwealth of $90,000,000 to repair, rehabilitate, 9 develop and acquire land and facilities for community 10 service and public recreational purposes AND PUBLIC ZOOS <-- 11 subject to such conditions and limitations as the General 12 Assembly may by law prescribe? 13 Section 4. Conduct of election. 14 The election shall be conducted in accordance with the act of 15 June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania 16 Election Code, except that the time limits for advertisement of 17 notice of the election may be waived as to the question. 18 Section 5. Use of proceeds. 19 Proceeds of borrowing shall be used to rehabilitate 20 deteriorated park and recreation facilities AND PUBLIC ZOOS; to <-- 21 acquire and develop land to preserve wildlife habitats AND <-- 22 PUBLIC ZOOS, complete public recreation areas and develop 23 fishing and boating areas; and to rehabilitate and convert 24 surplus schools and other public buildings OR NEW CONSTRUCTION <-- 25 to house HISTORICAL AND NATURAL INTERPRETIVE PROGRAMS, <-- 26 recreation programs and community services subject to such 27 conditions and limitations as the General Assembly may 28 prescribe. 29 SECTION 6. DEFINITIONS. <-- 30 THE FOLLOWING WORDS AND PHRASES WHEN USED IN THIS ACT SHALL 19830S0547B1559 - 2 -
1 HAVE THE MEANINGS GIVEN TO THEM IN THIS SECTION UNLESS THE
2 CONTEXT CLEARLY INDICATES OTHERWISE:
3 "PUBLIC ZOO." AN INSTALLATION FOR THE PUBLIC DISPLAY OF
4 LIVING ANIMALS WHICH IS OWNED, OPERATED OR FINANCIALLY ASSISTED
5 BY A POLITICAL SUBDIVISION IF THE FINANCIAL ASSISTANCE ANNUALLY
6 IS NOT LESS THAN $500,000 OR NOT LESS THAN 25% OF ITS ANNUAL
7 OPERATING COSTS.
8 Section 6 7. Effective date. <--
9 This act shall take effect immediately.
