                                     AN ACT

     1  Authorizing the Adams-Croyle Recreation Authority to convey to
     2     the United States of America, by and through the National
     3     Park Service, United States Department of the Interior, five
     4     tracts of land situated in Cambria County and acquired in
     5     part with Project 70 funds.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Authorization.
     9     Pursuant to the requirements of section 20(b) of the act of
    10  June 22, 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70
    11  Land Acquisition and Borrowing Act, the General Assembly
    12  authorizes the Adams-Croyle Recreation Authority of Cambria
    13  County to convey to the United States of America, by and through
    14  the National Park Service, United States Department of the
    15  Interior, five tracts of land situated in Cambria County and
    16  acquired in part with Project 70 funds for incorporation into
    17  the Johnstown Flood National Memorial.
    18  Section 2.  Freedom from restrictions.

     1     The land to be conveyed by the Adams-Croyle Recreation
     2  Authority to the United States of America shall be free of
     3  restrictions on use and alienation prescribed by section 20 of
     4  the act of June 22, 1964 (Sp.Sess., P.L.131, No.8), known as the
     5  Project 70 Land Acquisition and Borrowing Act.
     6  Section 3.  Land description.
     7     The Project 70 land to be conveyed to the United States of
     8  America is described as follows:
     9     (1)  All those certain tracts or parcels of land lying and
    10  being situated in Adams Township, Cambria County, Commonwealth
    11  of Pennsylvania and being described as follows:
    12                            Tract No. 1
    13         Beginning at a corner common to the lands of subject
    14     owner and the lands of the Johnstown Flood National Memorial,
    15     at a point on the westerly bank of the South Fork Branch of
    16     the Little Conemaugh River; thence, along said bank
    17     meandering in a southwesterly direction approximately 650.00
    18     feet to a corner common to lands of subject owner and the
    19     land of others; thence, along land of others, north 44
    20     degrees 28 minutes west, 100.00 feet to a point on the
    21     easterly line of the (now abandoned) Township Road 308, it
    22     being a portion of the aforementioned park; thence, along
    23     said line on an arc of a curve to the left whose radius is
    24     1,328.00 feet; arc length of 74.00 feet, chord bearing and
    25     distance of north 42 degrees 55 minutes 56 seconds east,
    26     72.00 feet, more or less, to a point; thence north 38 degrees
    27     36 minutes 56 seconds east, 113.55 feet to a point; thence
    28     north 34 degrees 00 minutes 56 seconds east, 79.96 feet to a
    29     point; thence, leaving said road and still along said
    30     memorial; north 61 degrees 51 minutes 56 seconds east, 363.34

     1     feet to the point of beginning.
     2     Containing 1.34 acres, more or less.
     3                            Tract No. 2
     4         Beginning at the intersection of the northerly right-of-
     5     way line of Legislative Route No.11010 with the westerly
     6     right-of-way line of Walnut Street, said street being a part
     7     of lands laid out in the plan of the Village of Saint
     8     Michaels, Pennsylvania; thence by said line of Route No.11010
     9     right-of-way north 61 degrees 00 minutes west to a point on
    10     the easterly right-of-way line of abandoned Township Road No.
    11     T-308, said point being located easterly 300 feet from
    12     station 255+36.47 of said Legislative Route No.11010; thence
    13     north 41 degrees 35 minutes west 37.05 feet; thence north 57
    14     degrees 24 minutes west 79.64 feet; thence north 53 degrees
    15     04 minutes west 70.02 feet to a point located north 33
    16     degrees 00 minutes east 20.00 feet from station 294+94 of
    17     said Legislative Route No.11010; thence north 33 degrees 00
    18     minutes east 65.00 feet; thence north 45 degrees 00 minutes
    19     west 286.00 feet to a point located 30.00 feet from the
    20     centerline of said abandoned Township Road No. T-308; thence
    21     on a variable curved line in an easterly direction 721.07
    22     feet; thence south 44 degrees 28 minutes east 920.00 feet;
    23     thence south 33 degrees 40 minutes east 590.00 feet to said
    24     westerly right-of-way line of Walnut Street; thence along
    25     said westerly right-of-way line of Walnut Street south 56
    26     degrees 20 minutes west 405.00 feet to the point of
    27     beginning.
    28     Containing 16.37 acres, more or less.
    29                            Tract No. 3
    30         Beginning at the intersection of the westerly right-of-

     1     way line of Walnut Street and the northeasterly right-of-way
     2     line of Washington Street, said streets being a part of land
     3     laid out in the plan of the Village of Saint Michaels,
     4     Pennsylvania; thence along said westerly right-of-way line of
     5     Walnut Street south 56 degrees 21 minutes west 50.00 feet;
     6     thence north 33 degrees 40 minutes west 590.00 feet; thence
     7     north 44 degrees 28 minutes east 980.00 feet to a point 30.00
     8     feet from the centerline of abandoned Township Road No. T-
     9     308; thence on a variable curved line, 30.00 feet from said
    10     centerline, in an easterly direction 721.07 feet; thence
    11     south 44 degrees 28 minutes east 100.00 feet to the left bank
    12     of the South Fork Branch of the Little Conemaugh River;
    13     thence along said left bank on a southeasterly meandering
    14     course approximately 1.275.00 feet; thence south 04 degrees
    15     39 minutes west 140.00 feet; thence south 44 degrees 28
    16     minutes east 350.00 feet, more or less, to its intersection
    17     with the easterly prolongation of the westerly right-of-way
    18     line of Walnut Street; thence along the said westerly right-
    19     of-way line of Walnut Street south 56 degrees 21 minutes west
    20     50.00 feet, more or less, to the point of beginning.
    21     Containing 8.47 acres, more or less.
    22  The above described parcels, designated as Tracts 2 and 3 are a
    23  portion of the same land conveyed unto the Adams-Croyle
    24  Recreation Authority by that certain Amended Notice of
    25  Condemnation filed for record in Deed Book 976, Page 928 in the
    26  Recorder of Deeds Office for the County of Cambria, Commonwealth
    27  of Pennsylvania.
    28     (2)  All those certain tracts or parcels of land lying and
    29  being situated in Croyle Township, Cambria County, Commonwealth
    30  of Pennsylvania and being described as follows:

     1                            Tract No. 4
     2         Beginning at a point on the easterly right-of-way line of
     3     the Pennsylvania Railroad at its intersection with the land
     4     of subject owner and the Johnstown Flood National Memorial;
     5     thence, along said Memorial, north 57 degrees 47 minutes
     6     east, 485.00 feet, more or less, to a point on the line of a
     7     tract of land now or formerly owned by D. E. Unger; thence,
     8     along the said Unger tract, south 27 degrees 52 minutes east,
     9     275.00 feet, more or less; south 38 degrees 52 minutes east,
    10     383.10 feet to a corner common to land of subject, D. E.
    11     Unger and a tract of land now or formerly owned by Jacob
    12     Wirrick, thence, along the said Wirrick tract, the following
    13     bearings and distances:
    14             south 43 degrees 40 minutes west, 185.00 feet;
    15             south 35 degrees 20 minutes west, 120.00 feet;
    16             south 12 degrees 40 minutes west, 39.00 feet;
    17             south 15 degrees 28 minutes east, 308.80 feet;
    18             south 17 degrees 30 minutes east, 116.00 feet;
    19             south 02 degrees 45 minutes west, 239.00 feet; and
    20             south 26 degrees 18 minutes west, 135.20 feet to a
    21     point; thence, on a line serving lands of subject owner,
    22     south 59 degrees 31 minutes west, 150.00 feet, more or less,
    23     to a point on the westerly line of the now abandoned Township
    24     Road 352; thence, along said line meandering in a southerly
    25     direction 400.00 feet, more or less, to a point; thence north
    26     76 degrees 17 minutes east, 450.00 feet, more or less, to a
    27     point on the easterly right-of-way line of aforementioned
    28     railroad; thence, along said line in a northerly direction
    29     400 feet, more or less, to a point; thence north 04 degrees
    30     39 minutes east, 675.00 feet to a point; thence, in a

     1     northerly direction, 670.00 feet to the point of beginning.
     2     Containing 24.00 acres, more or less.
     3                            Tract No. 5
     4         Beginning at the intersection of the easterly bank of the
     5     South Fork Branch of the Little Conemaugh River with the
     6     southerly property line of Tract 01-104, aS shown on the
     7     Johnstown Flood National Memorial Segment Map (4150-92001);
     8     thence, by said southerly property line, north 57 degrees 47
     9     minutes east, 40.00 feet to the westerly right-of-way line of
    10     the Pennsylvania Railroad; thence, along said right-of-way
    11     line by a curve to the right, having a radius of 1,243.57
    12     feet, a distance of 620.00 feet; continuing thence along said
    13     right-of-way line, south 04 degrees 39 minutes west, 1,240.00
    14     feet to said easterly bank of said river; thence along said
    15     right bank on the northerly meandering course, approximately
    16     1,800.00 feet to the point of beginning.
    17     Containing 9.17 acres, more or less.
    18     The above described parcels, designated as Tracts 4 and 5 are
    19  a portion of the same land conveyed unto the Adams-Croyle
    20  Recreation Authority, by that certain Amended Notice of
    21  Condemnation, dated September 12, 1974 and recorded in Deed Book
    22  976, Page 928 in the Recorder of Deeds Office for the County of
    23  Cambria, Commonwealth of Pennsylvania.
    24  SECTION 4.  LIMITATION ON USE OF PROPERTY.                        <--
    25     THE LAND CONVEYED PURSUANT TO THIS ACT SHALL BE USED FOR
    26  GOVERNMENTAL PURPOSES AND IF AT ANY TIME THE GOVERNMENT OR ITS
    27  SUCCESSOR IN FUNCTION AUTHORIZES OR PERMITS SAID PROPERTY TO BE
    28  USED FOR ANY PURPOSE OTHER THAN GOVERNMENTAL THE TITLE SHALL
    29  IMMEDIATELY REVERT AND REVEST IN THE COMMONWEALTH OF
    30  PENNSYLVANIA.
