AN ACT 1 Authorizing the Adams-Croyle Recreation Authority to convey to 2 the United States of America, by and through the National 3 Park Service, United States Department of the Interior, five 4 tracts of land situated in Cambria County and acquired in 5 part with Project 70 funds. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Authorization. 9 Pursuant to the requirements of section 20(b) of the act of 10 June 22, 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70 11 Land Acquisition and Borrowing Act, the General Assembly 12 authorizes the Adams-Croyle Recreation Authority of Cambria 13 County to convey to the United States of America, by and through 14 the National Park Service, United States Department of the 15 Interior, five tracts of land situated in Cambria County and 16 acquired in part with Project 70 funds for incorporation into 17 the Johnstown Flood National Memorial. 18 Section 2. Freedom from restrictions. 19 The land to be conveyed by the Adams-Croyle Recreation
1 Authority to the United States of America shall be free of 2 restrictions on use and alienation prescribed by section 20 of 3 the act of June 22, 1964 (Sp.Sess., P.L.131, No.8), known as the 4 Project 70 Land Acquisition and Borrowing Act. 5 Section 3. Land description. 6 The Project 70 land to be conveyed to the United States of 7 America is described as follows: 8 (1) All those certain tracts or parcels of land lying and 9 being situated in Adams Township, Cambria County, Commonwealth 10 of Pennsylvania and being described as follows: 11 Tract No. 1 12 Beginning at a corner common to the lands of subject 13 owner and the lands of the Johnstown Flood National Memorial, 14 at a point on the westerly bank of the South Fork Branch of 15 the Little Conemaugh River; thence, along said bank 16 meandering in a southwesterly direction approximately 650.00 17 feet to a corner common to lands of subject owner and the 18 land of others; thence, along land of others, north 44 19 degrees 28 minutes west, 100.00 feet to a point on the 20 easterly line of the (now abandoned) Township Road 308, it 21 being a portion of the aforementioned park; thence, along 22 said line on an arc of a curve to the left whose radius is 23 1,328.00 feet; arc length of 74.00 feet, chord bearing and 24 distance of north 42 degrees 55 minutes 56 seconds east, 25 72.00 feet, more or less, to a point; thence north 38 degrees 26 36 minutes 56 seconds east, 113.55 feet to a point; thence 27 north 34 degrees 00 minutes 56 seconds east, 79.96 feet to a 28 point; thence, leaving said road and still along said 29 memorial; north 61 degrees 51 minutes 56 seconds east, 363.34 30 feet to the point of beginning. 19830S0526B0576 - 2 -
1 Containing 1.34 acres, more or less. 2 Tract No. 2 3 Beginning at the intersection of the northerly right-of- 4 way line of Legislative Route No.11010 with the westerly 5 right-of-way line of Walnut Street, said street being a part 6 of lands laid out in the plan of the Village of Saint 7 Michaels, Pennsylvania; thence by said line of Route No.11010 8 right-of-way north 61 degrees 00 minutes west to a point on 9 the easterly right-of-way line of abandoned Township Road No. 10 T-308, said point being located easterly 300 feet from 11 station 255+36.47 of said Legislative Route No.11010; thence 12 north 41 degrees 35 minutes west 37.05 feet; thence north 57 13 degrees 24 minutes west 79.64 feet; thence north 53 degrees 14 04 minutes west 70.02 feet to a point located north 33 15 degrees 00 minutes east 20.00 feet from station 294+94 of 16 said Legislative Route No.11010; thence north 33 degrees 00 17 minutes east 65.00 feet; thence north 45 degrees 00 minutes 18 west 286.00 feet to a point located 30.00 feet from the 19 centerline of said abandoned Township Road No. T-308; thence 20 on a variable curved line in an easterly direction 721.07 21 feet; thence south 44 degrees 28 minutes east 920.00 feet; 22 thence south 33 degrees 40 minutes east 590.00 feet to said 23 westerly right-of-way line of Walnut Street; thence along 24 said westerly right-of-way line of Walnut Street south 56 25 degrees 20 minutes west 405.00 feet to the point of 26 beginning. 27 Containing 16.37 acres, more or less. 28 Tract No. 3 29 Beginning at the intersection of the westerly right-of- 30 way line of Walnut Street and the northeasterly right-of-way 19830S0526B0576 - 3 -
1 line of Washington Street, said streets being a part of land 2 laid out in the plan of the Village of Saint Michaels, 3 Pennsylvania; thence along said westerly right-of-way line of 4 Walnut Street south 56 degrees 21 minutes west 50.00 feet; 5 thence north 33 degrees 40 minutes west 590.00 feet; thence 6 north 44 degrees 28 minutes east 980.00 feet to a point 30.00 7 feet from the centerline of abandoned Township Road No. T- 8 308; thence on a variable curved line, 30.00 feet from said 9 centerline, in an easterly direction 721.07 feet; thence 10 south 44 degrees 28 minutes east 100.00 feet to the left bank 11 of the South Fork Branch of the Little Conemaugh River; 12 thence along said left bank on a southeasterly meandering 13 course approximately 1.275.00 feet; thence south 04 degrees 14 39 minutes west 140.00 feet; thence south 44 degrees 28 15 minutes east 350.00 feet, more or less, to its intersection 16 with the easterly prolongation of the westerly right-of-way 17 line of Walnut Street; thence along the said westerly right- 18 of-way line of Walnut Street south 56 degrees 21 minutes west 19 50.00 feet, more or less, to the point of beginning. 20 Containing 8.47 acres, more or less. 21 The above described parcels, designated as Tracts 2 and 3 are a 22 portion of the same land conveyed unto the Adams-Croyle 23 Recreation Authority by that certain Amended Notice of 24 Condemnation filed for record in Deed Book 976, Page 928 in the 25 Recorder of Deeds Office for the County of Cambria, Commonwealth 26 of Pennsylvania. 27 (2) All those certain tracts or parcels of land lying and 28 being situated in Croyle Township, Cambria County, Commonwealth 29 of Pennsylvania and being described as follows: 30 Tract No. 4 19830S0526B0576 - 4 -
1 Beginning at a point on the easterly right-of-way line of 2 the Pennsylvania Railroad at its intersection with the land 3 of subject owner and the Johnstown Flood National Memorial; 4 thence, along said Memorial, north 57 degrees 47 minutes 5 east, 485.00 feet, more or less, to a point on the line of a 6 tract of land now or formerly owned by D. E. Unger; thence, 7 along the said Unger tract, south 27 degrees 52 minutes east, 8 275.00 feet, more or less; south 38 degrees 52 minutes east, 9 383.10 feet to a corner common to land of subject, D. E. 10 Unger and a tract of land now or formerly owned by Jacob 11 Wirrick, thence, along the said Wirrick tract, the following 12 bearings and distances: 13 south 43 degrees 40 minutes west, 185.00 feet; 14 south 35 degrees 20 minutes west, 120.00 feet; 15 south 12 degrees 40 minutes west, 39.00 feet; 16 south 15 degrees 28 minutes east, 308.80 feet; 17 south 17 degrees 30 minutes east, 116.00 feet; 18 south 02 degrees 45 minutes west, 239.00 feet; and 19 south 26 degrees 18 minutes west, 135.20 feet to a 20 point; thence, on a line serving lands of subject owner, 21 south 59 degrees 31 minutes west, 150.00 feet, more or less, 22 to a point on the westerly line of the now abandoned Township 23 Road 352; thence, along said line meandering in a southerly 24 direction 400.00 feet, more or less, to a point; thence north 25 76 degrees 17 minutes east, 450.00 feet, more or less, to a 26 point on the easterly right-of-way line of aforementioned 27 railroad; thence, along said line in a northerly direction 28 400 feet, more or less, to a point; thence north 04 degrees 29 39 minutes east, 675.00 feet to a point; thence, in a 30 northerly direction, 670.00 feet to the point of beginning. 19830S0526B0576 - 5 -
1 Containing 24.00 acres, more or less. 2 Tract No. 5 3 Beginning at the intersection of the easterly bank of the 4 South Fork Branch of the Little Conemaugh River with the 5 southerly property line of Tract 01-104, aS shown on the 6 Johnstown Flood National Memorial Segment Map (4150-92001); 7 thence, by said southerly property line, north 57 degrees 47 8 minutes east, 40.00 feet to the westerly right-of-way line of 9 the Pennsylvania Railroad; thence, along said right-of-way 10 line by a curve to the right, having a radius of 1,243.57 11 feet, a distance of 620.00 feet; continuing thence along said 12 right-of-way line, south 04 degrees 39 minutes west, 1,240.00 13 feet to said easterly bank of said river; thence along said 14 right bank on the northerly meandering course, approximately 15 1,800.00 feet to the point of beginning. 16 Containing 9.17 acres, more or less. 17 The above described parcels, designated as Tracts 4 and 5 are 18 a portion of the same land conveyed unto the Adams-Croyle 19 Recreation Authority, by that certain Amended Notice of 20 Condemnation, dated September 12, 1974 and recorded in Deed Book 21 976, Page 928 in the Recorder of Deeds Office for the County of 22 Cambria, Commonwealth of Pennsylvania. 23 Section 4.
