We, the undersigned, Committee of Conference on the part of the Senate and House of Representatives for the purpose of considering Senate Bill No. 270, entitled: "An act amending the act of August 9, 1955 (P.L.323, No.130), entitled 'An act relating to counties of the third, fourth, fifth, sixth, seventh and eighth classes; amending, revising, consolidating and changing the laws relating thereto,' further providing for the filling of vacancies in certain circumstances," respectfully submit the following bill as our report: FRANK J. AN ACT 1 Establishing salaries and compensation of certain public 2 officials including justices and judges of Statewide courts, 3 judges of courts of common pleas, judge of the Philadelphia 4 Municipal Court, judges of the Philadelphia Traffic Court, 5 district justices and the Governor, the Lieutenant Governor, 6 the State Treasurer, the Auditor General, the Attorney 7 General and certain other State officers and the salary and 8 certain expenses of the members of the General Assembly; and 9 repealing certain inconsistent acts. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Short title. 13 This act shall be known and may be cited as the Public 14 Official Compensation Law. 15 Section 2. Judiciary. 16 (a) Supreme Court.--The annual salary of the Chief Justice 17 of the Supreme Court shall be $79,000 and the annual salary of 18 each of the other justices of the Supreme Court shall be 19 $76,500. 20 (b) Superior Court.--The annual salary of the President 21 Judge of the Superior Court shall be $76,000 and the annual 22 salary of the other judges of the Superior Court shall be 23 $74,500. 24 (c) Commonwealth Court.--The annual salary of the President 25 Judge of the Commonwealth Court shall be $76,000. The annual 26 salary of each of the other judges of the Commonwealth Court 27 shall be $74,500. 28 (d) Courts of common pleas.-- 29 (1) The annual salary of a President Judge of a court of 30 common pleas shall be fixed in accordance with the following 31 schedule: 32 (i) Allegheny County, $67,000. 33 (ii) Philadelphia, $67,500.
1 (iii) Judicial districts having six or more judges, 2 $66,000. 3 (iv) Judicial districts having three to five judges, 4 $65,500. 5 (v) Judicial districts having one or two judges, 6 $65,000. 7 (vi) Administrative judges of the divisions of the 8 Court of Common Pleas of Philadelphia County; divisions 9 of six or more judges, $66,000. 10 (vii) Administrative judges of the divisions of the 11 Court of Common Pleas of Philadelphia County with 12 divisions of five or less judges, $65,500. 13 (viii) Administrative Judge of divisions of the 14 Court of Common Pleas of Allegheny County with divisions 15 of six or more judges, $66,000. 16 (ix) Administrative Judge of divisions of the Court 17 of Common Pleas of Allegheny County of five or less 18 judges, $65,500. 19 (2) The other judges of the courts of common pleas shall 20 be paid an annual salary of $65,000. 21 (e) Philadelphia Municipal Court.--The President Judge of 22 the Philadelphia Municipal Court shall receive an annual salary 23 of $60,500. The annual salary for the other judges of the 24 Philadelphia Municipal Court shall be $59,000 for members of the 25 bar and $26,000 for judges who are not members of the bar. 26 (f) Philadelphia Traffic Court.--The annual salary of the 27 President Judge of the Philadelphia Traffic Court shall be 28 $31,000. The annual salary of the other judges of the 29 Philadelphia Traffic Court shall be $30,000. 30 (g) District justices.--A district justice shall receive an 19830S0270B1267 - 2 -
1 annual salary payable by the Commonwealth and computed by adding 2 to $16,500 the product of the population of his magisterial 3 district times 80¢ but in no event shall the salary exceed 4 $29,500. Furthermore, the annual salary for each magisterial 5 district shall be increased from the levels they were at prior 6 to this act by at least $3,000. 7 (h) Senior judges.--The compensation of the senior judges 8 pursuant to 42 Pa.C.S. § 4121 (relating to assignment of judges) 9 shall be $200 per day. In any calendar year the amount of 10 compensation which a senior judge shall be permitted to earn as 11 a senior judge shall not when added to retirement income paid by 12 the Commonwealth for such senior judge exceed the compensation 13 payable by the Commonwealth to a judge then in regular active 14 service on the court from which said senior judge retired. A 15 senior judge who so elects may serve without being paid all or 16 any portion of the compensation provided by this section. 17 Section 3. Compensation of Governor and Lieutenant Governor; 18 State Treasurer; Auditor General; Attorney 19 General; and heads of departments. 20 (a) The Governor, the Lieutenant Governor and Cabinet.--The 21 annual salaries of the Governor, the Lieutenant Governor and the 22 heads of the departments shall be as follows: Governor, $85,000; 23 Lieutenant Governor, $67,500; Adjutant General, $58,000; 24 Secretary of Aging, $61,500; Secretary of Agriculture, $58,000; 25 Secretary of Banking, $58,000; Secretary of Commerce, $61,500; 26 Secretary of the Commonwealth, $58,000; Secretary of Community 27 Affairs, $58,000; Secretary of Education, $65,000; Secretary of 28 Environmental Resources, $65,000; Secretary of General Services, 29 $61,500; Secretary of Health, $65,000; Insurance Commissioner, 30 $58,000; Secretary of Labor and Industry, $65,000; Secretary of 19830S0270B1267 - 3 -
1 Public Welfare, $65,000; Secretary of Revenue, $61,500; State 2 Police Commissioner, $61,500; Secretary of Transportation, 3 $65,000. 4 (b) Compensation of State Treasurer, Auditor General and 5 Attorney General.--The annual salaries of the State Treasurer, 6 Auditor General and Attorney General shall be as follows: State 7 Treasurer, $58,000; Auditor General, $58,000; Attorney General, 8 $65,000. 9 (c) Additional compensation prohibited.--Neither the 10 Governor, the Lieutenant Governor, State Treasurer, Auditor 11 General or Attorney General nor the head of any administrative 12 department shall receive any additional compensation for any 13 services rendered to the Commonwealth in any capacity. 14 Section 4. Members of the General Assembly. 15 (a) Members salary, expense and mileage.--The salary of 16 members of the General Assembly shall be $35,000 per annum and 17 mileage to and from their homes at the rate of 20¢ per mile, 18 circular, for each week a member was in actual attendance in 19 session between their homes and the State Capitol and, except as 20 provided herein, no other compensation shall be allowed 21 whatsoever, except each member of the General Assembly shall 22 receive an allowance for clerical assistance and other expenses 23 incurred during his term in connection with the duties of his 24 office in the sum of $7,500 annually; the salary to be payable 25 in equal monthly installments the first day of the month, 26 including the installment due December 1 of each even-numbered 27 year except that the salaries of Senators elected at the General 28 Election of 1982 during the remainder of their term shall be 29 $25,000 per annum and such members shall receive in addition to 30 the allowance for clerical assistance and other expenses, the 19830S0270B1267 - 4 -
1 expense allowance of $10,000 per annum. 2 (b) Officers and leaders salaries.-- 3 (1) Senate. 4 (i) The following officers of the Senate who shall 5 be elected by the Senate or their respective caucuses 6 shall, in addition to their salaries as members of the 7 General Assembly, receive the following as additional 8 compensation: President pro tempore, $19,600; Majority 9 Leader, $15,680; Minority Leader, $15,680; Majority Whip, 10 $11,900; Minority Whip, $11,900; Majority Caucus 11 Chairman, $7,420; Minority Caucus Chairman, $7,420; 12 Appropriations Chairman, $7,420; Minority Appropriations 13 Chairman, $7,420; Majority Caucus Secretary, $4,900; 14 Minority Caucus Secretary, $4,900; Minority Policy 15 Chairman, $4,900. 16 (ii) The following officers of the Senate who shall 17 be appointed by the President pro tempore shall, in 18 addition to their salaries as members of the General 19 Assembly, receive the following amounts as additional 20 compensation: Majority Policy Chairman, $4,900; Majority 21 Caucus Administrator, $4,900. 22 (iii) The following officer of the Senate who shall 23 be appointed by the Minority Leader shall, in addition to 24 his salary as a member of the General Assembly, receive 25 the following amount as compensation: Minority Caucus 26 Administrator, $4,900. 27 (2) House of Representatives. The following officers of 28 the House of Representatives who shall be elected by the 29 House or their respective caucuses, in addition to their 30 salary as members of the General Assembly, shall receive the 19830S0270B1267 - 5 -
1 following amounts as additional compensation: Speaker of the 2 House of Representatives, $19,600; Majority Leader, $15,680; 3 Minority Leader, $15,680; Majority Whip, $11,900; Minority 4 Whip, $11,900; Majority Caucus Chairman, $7,420; Minority 5 Caucus Chairman, $7,420; Appropriations Chairman, $7,420; 6 Minority Appropriations Chairman, $7,420; Majority Caucus 7 Secretary, $4,900; Minority Caucus Secretary, $4,900; 8 Majority Policy Chairman, $4,900; Minority Policy Chairman, 9 $4,900; Majority Caucus Administrator, $4,900; Minority 10 Caucus Administrator, $4,900. 11 Section 5. Additional expenses for members of the General 12 Assembly. 13 (a) Members expense allowance.--For the period commencing 14 December 1, 1983 and ending November 30, 1984, members of the 15 General Assembly shall receive, in addition to any allowance for 16 clerical assistance and other expenses, an unvouchered expense 17 allowance of $5,000 which shall be paid monthly on the first day 18 of the month. 19 (b) Senate officers expense allowance.--During the period 20 commencing December 1, 1983 and ending November 30, 1984, the 21 following officers of the Senate shall receive, in addition to 22 any other allowance for clerical assistance and other expenses, 23 an unvouchered expense allowance as follows: President pro 24 tempore, $2,800; Majority Leader, $2,240; Minority Leader, 25 $2,240; Majority Whip, $4,900; Minority Whip, $4,900; Majority 26 Caucus Chairman, $1,760; Minority Caucus Chairman, $1,760; 27 Appropriations Chairman, $6,360; Minority Appropriations 28 Chairman, $6,360; Majority Caucus Secretary, $1,500; Minority 29 Caucus Secretary, $1,500; Majority Policy Chairman, $1,500; 30 Minority Policy Chairman, $1,500; Majority Caucus Administrator, 19830S0270B1267 - 6 -
1 $1,500; Minority Caucus Administrator, $1,500; 2 (c) House officers expense allowance.--During the period 3 commencing December 1, 1983 and ending November 30, 1984, the 4 following officers of the House of Representatives shall 5 receive, in addition to any other allowance for clerical 6 assistance and other expenses, an unvouchered expense allowance 7 as follows: Speaker of the House of Representatives, $2,800; 8 Majority Leader, $2,240; Minority Leader, $2,240; Majority Whip, 9 $4,900; Minority Whip, $4,900; Majority Caucus Chairman, $1,760; 10 Minority Caucus Chairman, $1,760; Appropriations Chairman, 11 $6,360; Minority Appropriations Chairman, $6,360; Majority 12 Caucus Secretary, $1,500; Minority Caucus Secretary, $1,500; 13 Majority Policy Chairman, $1,500; Minority Policy Chairman, 14 $1,500; Majority Caucus Administrator, $1,500; Minority Caucus 15 Administrator, $1,500. 16 Section 6. Repeals. 17 (a) The Administrative Code of 1929.--Section 209 of the act 18 of April 9, 1929 (P.L.177, No.175), known as The Administrative 19 Code of 1929, is hereby repealed effective upon the third 20 Tuesday of January 1987. 21 (b) Public Official Compensation Law.--The following 22 sections of the act of June 1, 1956 (1955 P.L.1959, No.657), 23 entitled, as amended, "An act fixing the salaries and 24 compensation of the Chief Justice and judges of the Supreme 25 Court, the President Judge and judges of the Superior Court, the 26 judges of the courts of common pleas, the judges of the orphans' 27 courts, the judges of the County Court of Philadelphia and the 28 judges of the County Court and Juvenile Court of Allegheny 29 County, certain associate judges not learned in the law, certain 30 state officers, and the salary and expenses of the members of 19830S0270B1267 - 7 -
1 the General Assembly, and repealing certain inconsistent acts," 2 are repealed on the dates indicated: 3 (1) Sections 1, 2, 3, 3.1, 4, 4.1, 4.2 and 12 are 4 repealed effective December 1, 1983. 5 (2) Section 13 and any other sections of that act not 6 repealed heretofore or by this act are hereby repealed 7 effective the third Tuesday of January 1985. 8 (3) Sections 14 and 14.3 are repealed effective December 9 1, 1984. 10 (c) Magisterial District Reform Act.--Section 206(a) of the 11 act of July 15, 1976 (P.L.1014, No.204), known as the 12 Magisterial District Reform Act, is repealed effective December 13 1, 1983. 14 (d) Commonwealth Attorneys Act.--Section 203 of the act of 15 October 15, 1980 (P.L.950, No.164), known as the Commonwealth 16 Attorneys Act, is repealed effective the third Tuesday of 17 January 1985. 18 (e) Title 42.--42 Pa.C.S. § 3154 (relating to compensation 19 of judicial officers) is repealed effective December 1, 1983. 20 Section 7. Effective date. 21 (a) Sections 1, 2, 3(a) and 5 shall take effect December 1, 22 1983; section 5 shall expire November 30, 1984. 23 (b) Section 3(b) shall take effect on the third Tuesday of 24 January 1985. 25 (c) Section 4 shall take effect December 1, 1984. 26 (d) The remainder of this act shall take effect December 1, 27 1983.
