HOUSE RESOLUTION

No. 240 Session of 1984


        INTRODUCED BY KUKOVICH, DeWEESE, PISTELLA, CLARK, MICHLOVIC,
           TIGUE AND STEWART, JUNE 13, 1984

        REFERRED TO COMMITTEE ON RULES, JUNE 14, 1984

                                  A RESOLUTION

     1  Directing the Speaker of the House of Representatives to appoint
     2     a special committee to investigate the voting practices and
     3     procedures of members of the Pennsylvania Ethics Commission.

     4     WHEREAS, A complaint against Governor Dick Thornburgh was
     5  filed with the Pennsylvania Ethics Commission alleging a
     6  violation of the laws of the Commonwealth when the Executive
     7  Mansion was used as the site of an event intended to raise funds
     8  for a political purpose; and
     9     WHEREAS, Two gubernatorial appointees to the Pennsylvania
    10  Ethics Commission who had been in attendance at the event under
    11  question voted to dismiss the complaint; and
    12     WHEREAS, Public trust and confidence in the Pennsylvania
    13  Ethics Commission may have been compromised because of the
    14  voting procedures of its members; therefore be it
    15     RESOLVED, That the Speaker of the House of Representatives
    16  appoint a seven-member bi-partisan committee, four from the
    17  majority and three from the minority, to investigate the voting
    18  practices and procedures of members of the Pennsylvania Ethics

     1  Commission; and be it further
     2     RESOLVED, That the committee may hold hearings, take
     3  testimony and make its investigations at such places as it deems
     4  necessary in this Commonwealth. It may issue subpoenas under the
     5  hand and seal of its chairman commanding any person to appear
     6  before the committee and to answer questions touching matters
     7  properly being inquired into by the committee and to produce
     8  such books, papers, records and documents as the committee deems
     9  necessary. The subpoenas may be served upon any person and shall
    10  have the same effect as subpoenas issued out of the courts of
    11  this Commonwealth. Any person who willfully neglects or refuses
    12  to testify before the committee or to produce any books, papers,
    13  records or documents shall be subject to the penalties provided
    14  by the laws of this Commonwealth in such case. Each member of
    15  the committee shall have power to administer oaths and
    16  affirmations to witnesses appearing before the committee; and be
    17  it further
    18     RESOLVED, That the special committee will receive additional
    19  necessary staffing from current resources available to the
    20  Majority and Minority Caucuses; and be it further
    21     RESOLVED, That the committee report its findings and
    22  recommendations to the House of Representatives within 90 days.
