A CONCURRENT RESOLUTION 1 Directing the Joint State Government Commission to submit "The 2 Model Procurement Code" to the General Assembly as soon as 3 possible; and to appoint a task force to study the ways in 4 which the Commonwealth competes with private enterprise. 5 WHEREAS, It is the function of State government to initiate 6 policies and manage programs established by or pursuant to law; 7 and 8 WHEREAS, It is the function of the private enterprise system, 9 which is the source of economic strength, to provide goods and 10 services needed in government endeavors; and 11 WHEREAS, The Commonwealth should strive to achieve optimum 12 efficiency economy and productivity through early implementation 13 of "The Model Procurement Code" and the use of market analyses 14 to determine whether quality goods and services may be procured 15 most economically through competitive bidding, competitive 16 negotiation or government enterprise; and 17 WHEREAS, In a democratic free enterprise system, the 18 processes of competitive bidding and competitive negotiation
1 should serve to increase government purchases from private 2 suppliers, except in those areas where the public interest must 3 be protected by government oversight; and 4 WHEREAS, The proliferation of government to produce goods and 5 render services which are inefficient and costly is not in the 6 public interest; therefore be it 7 RESOLVED (the Senate concurring), That the Joint State 8 Government Commission complete its study of "The Model 9 Procurement Code" and report its findings to the General 10 Assembly; and be it further 11 RESOLVED, That the Joint State Government Commission appoint 12 a task force to determine the ways in which goods and services 13 required by the Commonwealth, excluding those goods and services 14 produced by the government in the public interest, may be most 15 economically and efficiently procured.
