                                     AN ACT

     1  Amending the act of May 18, 1937 (P.L.654, No.174), entitled, as
     2     amended, "An act to provide for the safety and to protect the
     3     health and morals of persons while employed; prescribing
     4     certain regulations and restrictions concerning places where
     5     persons are employed, and the equipment, apparatus,
     6     materials, devices and machinery used therein; prescribing
     7     certain powers and duties of the Department of Labor and
     8     Industry relative to the enforcement of this act; and fixing
     9     penalties," further providing for the operation of plant
    10     railroads.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 2(i) of the act of May 18, 1937 (P.L.654,
    14  No.174), entitled, as amended "An act to provide for the safety
    15  and to protect the health and morals of persons while employed;
    16  prescribing certain regulations and restrictions concerning
    17  places where persons are employed, and the equipment, apparatus,
    18  materials, devices and machinery used therein; prescribing
    19  certain powers and duties of the Department of Labor and
    20  Industry relative to the enforcement of this act; and fixing
    21  penalties," added October 7, 1976 (P.L.1107, No.225), is amended


     1  to read:
     2     Section 2.  General Safety and Health Requirements.--* * *
     3     (i)  All plant, scenic or other railroad operations other
     4  than those common carrier railroads presently subject to the
     5  jurisdiction of the Public Utility Commission shall be
     6  maintained and operated in such a manner as to prevent
     7  unreasonable or unnecessary hazards to workers or the public.
     8  Motive power, rolling stock, and roadbeds shall be designed,
     9  manufactured and maintained so as to be safe for its intended
    10  purpose and provide maximum safety to the public and the
    11  employes involved. Motive power used in plant railroad
    12  operations shall at all times be controlled by a person located
    13  within the cab of the motive power unit. No motive power unit in
    14  in-plant railroad operation shall utilize remote-control
    15  operating devices.
    16     Section 2.  This act shall take effect in 60 days.
