                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
     2     act concerning townships of the second class; and amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," increasing the fine for obstructing public roads or
     5     committing nuisances thereon.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1185 of the act of May 1, 1933 (P.L.103,
     9  No.69), known as The Second Class Township Code, reenacted and
    10  amended July 10, 1947 (P.L.1481, No.567), is amended to read:
    11     Section 1185.  Obstructions and Nuisances.--Any person who
    12  shall stop or obstruct any public road in any township, or
    13  commit any nuisance thereon by felling trees, making fences,
    14  turning the road, or in any other way, and who shall[,] not, on
    15  notice given by the township supervisors, forthwith remove the
    16  obstruction or nuisance and repair the damages done to such
    17  road, upon conviction in a summary proceeding, shall, for every
    18  such offense, pay a penalty of [not more than twenty-five
    19  dollars] at least fifty dollars but not more than one hundred

     1  dollars, and in default of the payment of such fine and costs,
     2  shall be sentenced to imprisonment of not more than ten days.
     3  Nothing in this section shall debar an indictment for any such
     4  nuisance as in case of misdemeanor at common law.
     5     Section 2.  This act shall take effect in 60 days.
