                                  A SUPPLEMENT

     1  To the act of July 7, 1972 (P.L.743, No.176), entitled "An act
     2     providing for the establishment and operation of Lincoln
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related institution in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; authorizing appropriations in amounts to be fixed
    10     annually by the General Assembly; providing for the auditing
    11     of accounts of expenditures from said appropriations;
    12     providing for public support and capital improvements;
    13     authorizing the issuance of bonds exempt from taxation within
    14     the Commonwealth; requiring the President to make an annual
    15     report of the operations of Lincoln University," making
    16     appropriations for carrying the same into effect; providing
    17     for a basis for payments of such appropriations; and
    18     providing a method of accounting for the funds appropriated.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  The following sums, or as much thereof as may be
    22  necessary, are hereby appropriated to the Trustees of Lincoln
    23  University, Chester County, for the fiscal year July 1, 1984 to
    24  June 30, 1985 for the purposes and in the amounts as shown:
    25     (1)  For educational and general expenses and


     1  for participation by a representative of the
     2  institution, appointed by the chief executive
     3  officer thereof, as a member of the Pennsylvania
     4  Academic Commission on Technological Development,
     5  a commission for inter-institutional communication
     6  regarding technological innovation and development
     7  and for dissemination of information on such
     8  matters to the Pennsylvania business community and
     9  others who may use such information for new
    10  business and job development in Pennsylvania, such
    11  commission to be composed of representatives of
    12  every State-owned or State-related educational or
    13  scientific institution receiving General Fund
    14  assistance from the Commonwealth..................    $4,816,000
    15     (2)  For the master's program in Human
    16  Services..........................................       203,000
    17     (3)  To enhance the recruitment and retention
    18  of disadvantaged students.........................       200,000
    19     (4)  To enhance the opportunity for equal
    20  education at Lincoln University in accordance with
    21  the plan submitted by the Department of Education
    22  and approved by the United States Office of Civil
    23  Rights and the appropriation to be managed and
    24  supervised by the Department of Education.........     1,000,000
    25     Section 2.  Payments to Lincoln University on account of the
    26  appropriations for the items provided in section 1 shall be made
    27  on the basis of costs during the fiscal year.
    28     Section 3.  (a)  Payments to Lincoln University of the
    29  appropriations provided in section 1 shall be made monthly
    30  during the fiscal year.

     1     (b)  Such monthly payments shall be made in accordance with
     2  the provisions of section 2 on the basis of estimated costs. The
     3  estimate of costs shall be submitted by Lincoln University to
     4  the Secretary of Education, the General Assembly and the State
     5  Treasurer not later than 30 days prior to the date on which such
     6  payment is to be made.
     7     Section 4.  (a)  Lincoln University shall apply the moneys
     8  appropriated by this act only for such purposes as are permitted
     9  in this act and shall at all times maintain proper records
    10  showing the application of such moneys. Not later than 120 days
    11  after the close of the fiscal year to which this act relates,
    12  Lincoln University shall file with the Secretary of Education,
    13  the General Assembly and the Auditor General of the Commonwealth
    14  a statement setting forth the amounts and purposes of all
    15  expenditures made from moneys appropriated by this act and
    16  costs, as provided in section 2, used as a basis for receipt of
    17  any appropriation during said fiscal year.
    18     (b)  Such statement of expenditures and costs shall be
    19  reviewed by the Auditor General of the Commonwealth, and he
    20  shall have the right, in respect to the moneys appropriated by
    21  this act, to audit and disallow expenditures made for purposes
    22  not permitted by this act, and to cause such sums to be
    23  recovered and paid by Lincoln University to the State Treasurer.
    24  In respect to expenditures made by the university from moneys
    25  other than those appropriated by this act, the Auditor General
    26  shall have the right to review only and he shall file annually
    27  with the General Assembly such information concerning said
    28  expenditures as the General Assembly or any of its committees
    29  may require.
    30     Section 5.  A report shall be submitted to the Governor and

     1  the Appropriations and Education Committees of the Senate and
     2  House of Representatives and shall include data for all
     3  programs. The report, to be submitted prior to September 1,
     4  1985, shall cover the 12-month period beginning with the summer
     5  term 1984 and shall include:
     6     (1)  The following counts and distributions for each term
     7  during the period:
     8     (i)  The definitions and numbers of faculty members employed
     9  full-time, of faculty members employed part-time, of full-time
    10  students enrolled in graduate courses, of full-time students
    11  enrolled in undergraduate courses, of part-time students
    12  enrolled in graduate courses, and of part-time students enrolled
    13  in undergraduate courses.
    14     (ii)  The total numbers of undergraduate student credit
    15  hours, divided into lower division and upper division course
    16  levels, and of graduate student credit hours divided into three
    17  course levels--master's, first professional and doctoral.
    18     (iii)  The number of different courses scheduled by level of
    19  instruction and the number of sections of individual instruction
    20  scheduled by level of instruction, each further subdivided by
    21  two-digit Classification of Instructional Program (CIP)
    22  categories of instructional programs of higher education as
    23  defined by the National Center for Education Statistics, United
    24  States Department of Education.
    25     (iv)  The number of terms scheduled and the dates thereof.
    26     (2)  For the summer term and the following academic year in
    27  total and for each two-digit CIP program category, a
    28  classification of faculty members or other professional
    29  employees by title including: professor, associate professor,
    30  assistant professor, instructor, lecturer, research associate,

     1  librarian and academic administrator; faculty members or other
     2  professional employees under each title to be subdivided by type
     3  of assignment: teaching and nonteaching, and each such set of
     4  faculty members or other professional employees to be further
     5  subdivided by type of employment: full-time or part-time and the
     6  following aggregates for each such subdivided classification:
     7     (i)  The number of faculty and other professional employees
     8  and their full-time equivalence in instructional and
     9  noninstructional functions.
    10     (ii)  The sum of credits assigned to undergraduate classroom
    11  courses and the sum of credits assigned to graduate classroom
    12  courses taught, divided into lower division, upper division,
    13  master's, first professional and doctoral course levels.
    14     (iii)  The sum of credits assigned to undergraduate
    15  individual instruction courses and the sum of credits assigned
    16  to graduate individual instruction courses taught, divided into
    17  lower division, upper division, master's, first professional and
    18  doctoral course levels.
    19     (iv)  The sum of undergraduate classroom student credit hours
    20  and the sum of graduate classroom student credit hours
    21  generated; divided into lower division, upper division,
    22  master's, first professional and doctoral course levels.
    23     (v)  The sum of undergraduate individual instruction student
    24  credit hours and the sum of graduate individual instruction
    25  student credit hours generated; divided into lower division,
    26  upper division, master's, first professional and doctoral course
    27  levels.
    28     (vi)  The total salary paid for instructional functions and
    29  for noninstructional functions and the amount of this salary
    30  paid for each of these functions from university funds, Federal

     1  funds and other funds.
     2     (3)  For each term of the period covered for each faculty
     3  member employed full-time identified by two-digit CIP program
     4  category and title, the report shall contain an analysis of the
     5  average hours per week spent in university-related activities,
     6  stating specifically hours spent in undergraduate classroom
     7  contact and graduate classroom contact, hours spent in
     8  preparation, hours spent in research and hours spent in public
     9  service.
    10     Section 6.  In addition to the requirements in section 5
    11  relative to this appropriation, the report covering the 12-month
    12  period beginning with the summer term 1983 shall include for all
    13  programs of the university:
    14     (1)  Minimum number of credits required for a baccalaureate
    15  degree and for a master's degree.
    16     (2)  Number of bachelor's degrees, master's degrees, first
    17  professional degrees, and doctoral degrees awarded in 1982,
    18  1983, 1984 and estimated 1985.
    19     Section 7.  Lincoln University shall provide such information
    20  as may be necessary to carry out the provisions of this act and
    21  in such form and manner as the Department of Education may
    22  prescribe.
    23     Section 8.  Lincoln University shall report its revenues and
    24  expenditures and present its financial statements required under
    25  the provisions of this act in accordance with generally accepted
    26  accounting principles and procedures for educational
    27  institutions as set forth in the "Higher Education Finance
    28  Manual" United States Department of Health, Education and
    29  Welfare (1975) with the exceptions set forth in the
    30  "Commonwealth of Pennsylvania Budget Instructions for State-

     1  Related Universities, Phase I, Fiscal Year 1984-1985." Credits
     2  granted for nontraditional programs such as CLEP, lifelong
     3  learning, etc., including all related costs and revenues thereof
     4  shall be excluded from the function of "Instruction" and
     5  included under "Public Service."
     6     Section 9.  This act shall take effect July 1, 1984 or, if
     7  enacted subsequent to that date, then immediately.
