           JUNE 19, 1984

                                  A SUPPLEMENT

     1  To the act of November 30, 1965 (P.L.843, No.355), entitled "An
     2     act providing for the establishment and operation of Temple
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related university in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; providing for public support and capital
    10     improvements; authorizing appropriations in amounts to be
    11     fixed annually by the General Assembly; providing for the
    12     auditing of accounts of expenditures from said
    13     appropriations; authorizing the issuance of bonds exempt from
    14     taxation within the Commonwealth; requiring the President to
    15     make an annual report of the operations of Temple
    16     University," making appropriations for carrying the same into
    17     effect; providing for a basis for payments of such
    18     appropriations; and providing a method of accounting for the
    19     funds appropriated.

    20     The General Assembly of the Commonwealth of Pennsylvania
    21  hereby enacts as follows:
    22     Section 1.  The following sums or as much thereof as may be
    23  necessary, are hereby appropriated to the Trustees of Temple
    24  University for the fiscal year July 1, 1984 to June 30, 1985 for
    25  the purposes and in the amounts as shown:

     1     (1)  For educational and general expenses and
     2  for participation by a representative of the
     3  institution, appointed by the chief executive
     4  officer thereof, as a member of the Pennsylvania
     5  Academic Commission on Technological Development,
     6  a commission for inter-institutional communication
     7  regarding technological innovation and development
     8  and for dissemination of information on such
     9  matters to the Pennsylvania business community and
    10  others who may use such information for new
    11  business and job development in Pennsylvania, such
    12  commission to be composed of representatives of
    13  every State-owned or State-related educational or
    14  scientific institution receiving General Fund
    15  assistance from the community.....................   $86,841,000

    24     Section 2.  Payments to Temple University on account of the
    25  appropriations for all items as provided in section 1 shall be
    26  made on the basis of costs during the fiscal year.
    27     Section 3.  If necessary, Temple University may transfer
    28  funds among the appropriations listed in section 1(1) and (2):
    29  Provided, That the aggregate amount transferred into or out of
    30  each appropriation during the fiscal year shall not exceed 5% of

     1  the amount specifically appropriated for that purpose.
     2     Section 4.  (a)  Payment to Temple University of the
     3  appropriations provided in section 1 shall be made monthly
     4  during the fiscal year.
     5     (b)  Such monthly payments shall be made in accordance with
     6  the provisions of section 2 on the basis of estimated costs. The
     7  estimate of costs shall be submitted by Temple University to the
     8  Secretary of Education, the General Assembly and the State
     9  Treasurer not later than 30 days prior to the date on which such
    10  payment is to be made.
    11     Section 5.  (a)  Temple University shall apply the moneys
    12  appropriated by this act only for such purposes as are permitted
    13  in this act and shall at all times maintain proper records
    14  showing the application of such moneys. Not later than 120 days
    15  after the close of the fiscal year to which this act relates,
    16  Temple University shall file with the Secretary of Education,
    17  the General Assembly and the Auditor General of the Commonwealth
    18  a statement setting forth the amounts and purposes of all
    19  expenditures made from moneys appropriated by this act and other
    20  university accounts during said fiscal year as provided in
    21  section 2 used as a basis for receipt of any appropriation
    22  during said fiscal year.
    23     (b)  Such statement of expenditures and costs shall be
    24  reviewed by the Auditor General of the Commonwealth, and he
    25  shall have the right, in respect to the moneys appropriated by
    26  this act, to audit and disallow expenditures made for purposes
    27  not permitted by this act and to cause such sums to be recovered
    28  and paid by Temple University to the State Treasurer. In respect
    29  to expenditures made by the university from moneys other than
    30  those appropriated by this act, the Auditor General shall have

     1  the right to review only and he shall file annually with the
     2  General Assembly such information concerning said expenditures
     3  as the General Assembly or any of its committees may require.
     4     Section 6.  A report shall be submitted to the Governor and
     5  the Appropriations and Education Committees of the Senate and
     6  House of Representatives and shall include data for all programs
     7  except the Doctor of Medicine program. The report, to be
     8  submitted prior to September 1, 1985, shall cover the 12-month
     9  period beginning with the summer term 1984 and shall include
    10     (1)  The following counts and distributions for each term
    11  during the period:
    12     (i)  The definitions and numbers of faculty members employed
    13  full-time, of faculty members employed part-time, of full-time
    14  students enrolled in graduate courses, of full-time students
    15  enrolled in undergraduate courses, of part-time students
    16  enrolled in graduate courses, and of part-time students enrolled
    17  in undergraduate courses.
    18     (ii)  The total numbers of undergraduate student credit
    19  hours, divided into lower division and upper division course
    20  levels, and of graduate student credit hours divided into three
    21  course levels--master's, first professional and doctoral.
    22     (iii)  The number of different courses scheduled by level of
    23  instruction, and the number of sections of individual
    24  instruction scheduled by level of instruction, each further
    25  subdivided by two-digit Classification of Instructional Program
    26  (CIP) categories of instructional programs of higher education
    27  as defined by the National Center for Education Statistics,
    28  United States Department of Education.
    29     (iv)  The number of terms scheduled and the dates thereof.
    30     (2)  For the summer term and the following academic year in

     1  total and for each two-digit CIP program category, a
     2  classification of faculty members or other professional
     3  employees by title including: professor, associate professor,
     4  assistant professor, instructor, lecturer, research associate,
     5  librarian and academic administrator; faculty members or other
     6  professional employees under each title to be subdivided by type
     7  of assignment: teaching and nonteaching, and each such set of
     8  faculty members or other professional employees to be further
     9  subdivided by type of employment: full-time or part-time and the
    10  following aggregates for each such subdivided classification:
    11     (i)  The number of faculty and other professional employees
    12  and their full-time equivalence in instructional and
    13  noninstructional functions.
    14     (ii)  The sum of credits assigned to undergraduate classroom
    15  courses and the sum of credits assigned to graduate classroom
    16  courses taught, divided into lower division, upper division,
    17  master's, first professional and doctoral course levels.
    18     (iii)  The sum of credits assigned to undergraduate
    19  individual instruction courses and the sum of credits assigned
    20  to graduate individual instruction courses taught, divided into
    21  lower division, upper division, master's, first professional and
    22  doctoral course levels.
    23     (iv)  The sum of undergraduate classroom student credit hours
    24  and the sum of graduate classroom student credit hours
    25  generated; divided into lower division, upper division,
    26  master's, first professional and doctoral course levels.
    27     (v)  The sum of undergraduate individual instruction student
    28  credit hours and the sum of graduate individual instruction
    29  credit hours generated: divided into lower division, upper
    30  division, master's, first professional and doctoral course

     1  levels.
     2     (vi)  The total salary paid for instructional functions and
     3  for noninstructional functions and the amount of this salary
     4  paid for each of these functions from university funds, Federal
     5  funds and other funds.
     6     (3)  For each term of the period covered for each faculty
     7  member employed full-time identified by two-digit CIP program
     8  category and title, the report shall contain an analysis of the
     9  average hours per week spent in university-related activities,
    10  stating specifically hours spent in undergraduate classroom
    11  contact and graduate classroom contact, hours spent in
    12  preparation, hours spent in research and hours spent in public
    13  service.
    14     Section 7.  In addition to the requirements in section 6
    15  relative to this appropriation, each report covering the 12-
    16  month period beginning with the summer term 1984 shall include
    17  for all programs of the university:
    18     (1)  Minimum number of credits required for a baccalaureate
    19  degree and for a master's degree.
    20     (2)  Number of bachelor's degrees, master's degrees, first
    21  professional degrees, and doctoral degrees awarded in 1982,
    22  1983, 1984 and estimated 1985.
    23     Section 8.  Temple University shall provide such information
    24  as may be necessary to carry out this act and in such form and
    25  manner as the Department of Education may prescribe.
    26     Section 9.  Temple University shall report its revenues and
    27  expenditures and present its financial statements required under
    28  the provisions of this act in accordance with generally accepted
    29  accounting principles and procedures for educational
    30  institutions as set forth in the "Higher Education Finance

     1  Manual" United States Department of Health, Education and
     2  Welfare (1975) with the exceptions set forth in the
     3  "Commonwealth of Pennsylvania Budget Instructions for State
     4  Related Universities, Phase I, Fiscal Year 1984-1985." Credits
     5  granted for nontraditional programs such as CLEP, lifelong
     6  learning, etc., including all related costs and revenues thereof
     7  shall be excluded from the function of "Instruction" and
     8  included under "Public Service."
     9     Section 10.  This act shall take effect July 1, 1984 or, if
    10  enacted subsequent to that date, then immediately.
