To the Members of the House of Representatives and Senate:
We, the undersigned, Committee of Conference on the part of the House of Representatives and Senate for the purpose of considering House Bill No. 2052, entitled: "A supplement to the act of April 1, 1863 (P.L.213, No.227), entitled 'An act to accept the grant of Public Lands, by the United States, to the several states, for the endowment of Agricultural Colleges,' making appropriations for carrying the same into effect; providing for a basis for payments of such appropriations; and providing a method of accounting for the funds appropriated," respectfully submit the following bill as our report: MAX PIEVSKY JAMES J. A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect; providing for a basis for payments of such 6 appropriations; and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums or as much thereof as 17 may be necessary are hereby appropriated to the Trustees of 18 Pennsylvania State University for the fiscal year July 1, 1984 19 to June 30, 1985 for the purposes and in the amounts as shown: 20 (1) For educational and general expenses and 21 for participation by a representative of the 22 institution, appointed by the chief executive 23 officer thereof, as a member of the Pennsylvania 24 Academic Commission on Technological Development, 25 a commission for inter-institutional communication 26 regarding technological innovation and development 27 and for dissemination of information on such 28 matters to the Pennsylvania business community and 29 others who may use such information for new 30 business and job development in Pennsylvania, such 31 commission to be composed of representatives of 32 every State-owned or State-related educational or

Payments to Pennsylvania State University on 22 account of the appropriations for all items as provided in 23 section 1 shall be made on the basis of costs during the fiscal 24 year. 25 Section 3. If necessary, Pennsylvania State University may 26 transfer funds among the appropriations listed in section 1(1), 27 (2), (4), (5) and (6): Provided, That the aggregate amount 28 transferred into or out of each appropriation during the fiscal 29 year shall not exceed 5% of the amount specifically appropriated 30 for that purpose. 19840H2052B3390 - 2 -
1 Section 4. (a) Payments to Pennsylvania State University of 2 the appropriations provided in section 1 shall be made monthly 3 during the fiscal year. 4 (b) Such monthly payments shall be made in accordance with 5 the provisions of section 2 on the basis of estimated costs. The 6 estimate of costs shall be submitted by Pennsylvania State 7 University to the Secretary of Education, the General Assembly 8 and the State Treasurer not later than 30 days prior to the date 9 on which such payment is to be made. 10 Section 5. Notwithstanding any provision of the General 11 Appropriation Act of 1984 relating to the payment of retirement 12 expenses, the Trustees of Pennsylvania State University shall 13 make all required payments to the State Employees' Retirement 14 Fund from the funds appropriated pursuant to this act. 15 Section 6. (a) Pennsylvania State University shall apply 16 the moneys appropriated by this act only for such purposes as 17 are permitted in this act and shall at all times maintain proper 18 records showing the application of such moneys. Not later than 19 120 days after the close of the fiscal year to which this act 20 relates, Pennsylvania State University shall file with the 21 Secretary of Education, the General Assembly and the Auditor 22 General of the Commonwealth a statement setting forth the 23 amounts and purposes of all expenditures made from moneys 24 appropriated by this act and other university accounts during 25 said fiscal year as provided in section 2 used as a basis for 26 receipt of any appropriation during said fiscal year. 27 (b) Such statement of expenditures and costs shall be 28 reviewed by the Auditor General of the Commonwealth, and he 29 shall have the right, in respect to the moneys appropriated by 30 this act, to audit and disallow expenditures made for purposes 19840H2052B3390 - 3 -
1 not permitted by this act and to cause such sums to be recovered 2 and paid by Pennsylvania State University to the State 3 Treasurer. In respect to expenditures made by the university 4 from moneys other than those appropriated by this act, the 5 Auditor General shall have the right to review only and he shall 6 file annually with the General Assembly such information 7 concerning such expenditures as the General Assembly or any of 8 its committees may require. 9 Section 7. A report shall be submitted to the Governor and 10 the Appropriations and Education Committees of the Senate and 11 House of Representatives and shall include data for all programs 12 except the Doctor of Medicine program. The report, to be 13 submitted prior to September 1, 1985, shall cover the 12-month 14 period beginning with the summer term 1984 and shall include: 15 (1) The following counts and distributions for each term 16 during the period: 17 (i) The definitions and numbers of faculty members employed 18 full-time, of faculty members employed part-time, of full-time 19 students enrolled in graduate courses, of full-time students 20 enrolled in undergraduate courses, of part-time students 21 enrolled in graduate courses, and of part-time students enrolled 22 in undergraduate courses. 23 (ii) The total numbers of undergraduate student credit 24 hours, divided into lower division and upper division course 25 levels, and of graduate student credit hours divided into three 26 course levels--master's, first professional and doctoral. 27 (iii) The number of different courses scheduled by level of 28 instruction and the number of sections of individual instruction 29 scheduled by level of instruction, each further subdivided by 30 two-digit Classification of Instructional Program (CIP) 19840H2052B3390 - 4 -
1 categories of instructional programs of higher education as 2 defined by the National Center for Education Statistics, U.S. 3 Department of Education. 4 (iv) The number of terms scheduled and the dates thereof. 5 (2) For the summer term and the following academic year in 6 total and for each two-digit CIP program category, a 7 classification of faculty members or other professional 8 employees by title including: professor, associate professor, 9 assistant professor, instructor, lecturer, research associate, 10 librarian and academic administrator; faculty members or other 11 professional employees under each title to be subdivided by type 12 of assignment: teaching and nonteaching, and each such set of 13 faculty members or other professional employees to be further 14 subdivided by type of employment: full-time or part-time and the 15 following aggregates for each such subdivided classification: 16 (i) The number of faculty and other professional employees 17 and their full-time equivalence in instructional and 18 noninstructional functions. 19 (ii) The sum of credits assigned to undergraduate classroom 20 courses and the sum of credits assigned to graduate classroom 21 courses taught, divided into lower division, upper division, 22 master's, first professional and doctoral course levels. 23 (iii) The sum of credits assigned to undergraduate 24 individual instruction courses and the sum of credits assigned 25 to graduate individual instruction courses taught, divided into 26 lower division, upper division, master's, first professional and 27 doctoral course levels. 28 (iv) The sum of undergraduate classroom student credit hours 29 and the sum of graduate classroom student credit hours 30 generated; divided into lower division, upper division, 19840H2052B3390 - 5 -
1 master's, first professional and doctoral course levels. 2 (v) The sum of undergraduate individual instruction student 3 credit hours and the sum of graduate individual instruction 4 student credit hours generated; divided into lower division, 5 upper division, master's, first professional and doctoral course 6 levels. 7 (vi) The total salary paid for instructional functions and 8 for noninstructional functions and the amount of this salary 9 paid for each of these functions from university funds, Federal 10 funds and other funds. 11 (3) For each term of the period covered for each faculty 12 member employed full-time identified by two-digit CIP program 13 category and title, the report shall contain an analysis of the 14 average hours per week spent in university-related activities, 15 stating specifically hours spent in undergraduate classroom 16 contact and graduate classroom contact, hours spent in 17 preparation, hours spent in research and hours spent in public 18 service. 19 Section 8. In addition to the requirements in section 7 20 relative to this appropriation, the report covering the 12-month 21 period beginning with the summer term 1984 shall include for all 22 programs of the university: 23 (1) Minimum number of credits required for a baccalaureate 24 degree and for a master's degree. 25 (2) Number of bachelor's degrees, master's degrees, first 26 professional degrees, and doctoral degrees awarded in 1982, 27 1983, 1984 and estimated 1985. 28 Section 9. Pennsylvania State University shall provide such 29 information as may be necessary to carry out the provisions of 30 this act and in such form and manner as the Department of 19840H2052B3390 - 6 -
1 Education may prescribe. 2 Section 10. Pennsylvania State University shall report its 3 revenues and expenditures and present its financial statements 4 required under the provisions of this act in accordance with 5 generally accepted accounting principles and procedures for 6 educational institutions as set forth in "Higher Education 7 Finance Manual" United States Department of Health, Education 8 and Welfare (1975) with the exceptions set forth in the 9 "Commonwealth of Pennsylvania Budget Instructions for State 10 Related Universities, Phase I, Fiscal Year 1982-1983." Credits 11 granted for nontraditional programs such as CLEP, lifelong 12 learning, etc., including all related costs and revenues thereof 13 shall be excluded from the function of "Instruction" and 14 included under "Public Service." 15 Section 11.
