A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect; providing for a basis for payments of such 6 appropriations; and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums or as much thereof as 17 may be necessary are hereby appropriated to the Trustees of 18 Pennsylvania State University for the fiscal year July 1, 1984 19 to June 30, 1985 for the purposes and in the amounts as shown: 20 (1) For educational and general expenses and
1 for participation by a representative of the 2 institution, appointed by the chief executive 3 officer thereof, as a member of the Pennsylvania 4 Academic Commission on Technological Development, 5 a commission for Inter-institutional communication 6 regarding technological innovation and development 7 and for dissemination of information on such 8 matters to the Pennsylvania business community and 9 others who may use such information for new 10 business and job development in Pennsylvania, such 11 commission to be composed of representatives of 12 every State-owned or State-related educational or 13 scientific institution receiving general fund 14 assistance from the Commonwealth.................. $118,557,000 15 (2) For cost of research...................... 10,627,000 16 (3) For instruction - Doctor of Medicine only. 3,381,000 17 (4) For cost of agricultural research......... 12,647,000 18 (5) For cost of agricultural extension 19 services.......................................... 10,702,000 20 (6) For the cost of operating Elizabethtown 21 Hospital.......................................... 3,561,000 22 (7) For cost of soil survey................... 100,000 23 (8) To enhance recruitment and retention of 24 disadvantaged students............................ 200,000 25 (9) For the purchase of services from the 26 Buhl-Henderson Community Library of Sharon, 27 Pennsylvania...................................... 25,000 28 (10) For research into and operation of an 29 oilfired boiler converted to coal-slurry.......... 600,000 30 Section 2. Payments to Pennsylvania State University on 19840H2052B2785 - 2 -
1 account of the appropriations for all items as provided in 2 section 1 shall be made on the basis of costs during the fiscal 3 year. 4 Section 3. If necessary, Pennsylvania State University may 5 transfer funds among the appropriations listed in section 1(1), 6 (2), (3), (5) and (6): Provided, That the aggregate amount 7 transferred into or out of each appropriation during the fiscal 8 year shall not exceed 5% of the amount specifically appropriated 9 for that purpose. 10 Section 4. (a) Payments to Pennsylvania State University of 11 the appropriations provided in section 1 shall be made monthly 12 during the fiscal year. 13 (b) Such monthly payments shall be made in accordance with 14 the provisions of section 2 on the basis of estimated costs. The 15 estimate of costs shall be submitted by Pennsylvania State 16 University to the Secretary of Education, the General Assembly 17 and the State Treasurer not later than 30 days prior to the date 18 on which such payment is to be made. 19 Section 5. Notwithstanding any provision of the General 20 Appropriation Act of 1984 relating to the payment of retirement 21 expenses, the Trustees of Pennsylvania State University shall 22 make all required payments to the State Employees' Retirement 23 Fund from the funds appropriated pursuant to this act. 24 Section 6. (a) Pennsylvania State University shall apply 25 the moneys appropriated by this act only for such purposes as 26 are permitted in this act and shall at all times maintain proper 27 records showing the application of such moneys. Not later than 28 120 days after the close of the fiscal year to which this act 29 relates, Pennsylvania State University shall file with the 30 Secretary of Education, the General Assembly and the Auditor 19840H2052B2785 - 3 -
1 General of the Commonwealth a statement setting forth the 2 amounts and purposes of all expenditures made from moneys 3 appropriated by this act and other university accounts during 4 said fiscal year as provided in section 2 used as a basis for 5 receipt of any appropriation during said fiscal year. 6 (b) Such statement of expenditures and costs shall be 7 reviewed by the Auditor General of the Commonwealth, and he 8 shall have the right, in respect to the moneys appropriated by 9 this act, to audit and disallow expenditures made for purposes 10 not permitted by this act and to cause such sums to be recovered 11 and paid by Pennsylvania State University to the State 12 Treasurer. In respect to expenditures made by the university 13 from moneys other than those appropriated by this act, the 14 Auditor General shall have the right to review only and he shall 15 file annually with the General Assembly such information 16 concerning such expenditures as the General Assembly or any of 17 its committees may require. 18 Section 7. A report shall be submitted to the Governor and 19 the Appropriations and Education Committees of the Senate and 20 House of Representatives and shall include data for all programs 21 except the Doctor of Medicine program. The report, to be 22 submitted prior to September 1, 1985, shall cover the 12-month 23 period beginning with the summer term 1984 and shall include: 24 (1) The following counts and distributions for each term 25 during the period: 26 (i) The definitions and numbers of faculty members employed 27 full-time, of faculty members employed part-time, of full-time 28 students enrolled in graduate courses, of full-time students 29 enrolled in undergraduate courses, of part-time students 30 enrolled in graduate courses, and of part-time students enrolled 19840H2052B2785 - 4 -
1 in undergraduate courses. 2 (ii) The total numbers of undergraduate student credit 3 hours, divided into lower division and upper division course 4 levels, and of graduate student credit hours divided into three 5 course levels--master's, first professional and doctoral. 6 (iii) The number of different courses scheduled by level of 7 instruction and the number of sections of individual instruction 8 scheduled by level of instruction, each further subdivided by 9 two-digit Classification of Instructional Program (CIP) 10 categories of instructional programs of higher education as 11 defined by the National Center for Education Statistics, U.S. 12 Department of Education. 13 (iv) The number of terms scheduled and the dates thereof. 14 (2) For the summer term and the following academic year in 15 total and for each two-digit CIP program category, a 16 classification of faculty members or other professional 17 employees by title including: professor, associate professor, 18 assistant professor, instructor, lecturer, research associate, 19 librarian and academic administrator; faculty members or other 20 professional employees under each title to be subdivided by type 21 of assignment: teaching and nonteaching, and each such set of 22 faculty members or other professional employees to be further 23 subdivided by type of employment: full-time or part-time and the 24 following aggregates for each such subdivided classification: 25 (i) The number of faculty and other professional employees 26 and their full-time equivalence in instructional and 27 noninstructional functions. 28 (ii) The sum of credits assigned to undergraduate classroom 29 courses and the sum of credits assigned to graduate classroom 30 courses taught, divided into lower division, upper division, 19840H2052B2785 - 5 -
1 master's, first professional and doctoral course levels. 2 (iii) The sum of credits assigned to undergraduate 3 individual instruction courses and the sum of credits assigned 4 to graduate individual instruction courses taught, divided into 5 lower division, upper division, master's, first professional and 6 doctoral course levels. 7 (iv) The sum of undergraduate classroom student credit hours 8 and the sum of graduate classroom student credit hours 9 generated; divided into lower division, upper division, 10 master's, first professional and doctoral course levels. 11 (v) The sum of undergraduate individual instruction student 12 credit hours and the sum of graduate individual instruction 13 student credit hours generated; divided into lower division, 14 upper division, master's, first professional and doctoral course 15 levels. 16 (vi) The total salary paid for instructional functions and 17 for noninstructional functions and the amount of this salary 18 paid for each of these functions from university funds, Federal 19 funds and other funds. 20 (3) For each term of the period covered for each faculty 21 member employed full-time identified by two-digit CIP program 22 category and title, the report shall contain an analysis of the 23 average hours per week spent in university-related activities, 24 stating specifically hours spent in undergraduate classroom 25 contact and graduate classroom contact, hours spent in 26 preparation, hours spent in research and hours spent in public 27 service. 28 Section 8. In addition to the requirements in section 7 29 relative to this appropriation, the report covering the 12-month 30 period beginning with the summer term 1984 shall include for all 19840H2052B2785 - 6 -
1 programs of the university: 2 (1) Minimum number of credits required for a baccalaureate 3 degree and for a master's degree. 4 (2) Number of bachelor's degrees, master's degrees, first 5 professional degrees, and doctoral degrees awarded in 1982, 6 1983, 1984 and estimated 1985. 7 Section 9. Pennsylvania State University shall provide such 8 information as may be necessary to carry out the provisions of 9 this act and in such form and manner as the Department of 10 Education may prescribe. 11 Section 10. Pennsylvania State University shall report its 12 revenues and expenditures and present its financial statements 13 required under the provisions of this act in accordance with 14 generally accepted accounting principles and procedures for 15 educational institutions as set forth in "Higher Education 16 Finance Manual" United States Department of Health, Education 17 and Welfare (1975) with the exceptions set forth in the 18 "Commonwealth of Pennsylvania Budget Instructions for State 19 Related Universities, Phase I, Fiscal Year 1982-1983." Credits 20 granted for nontraditional programs such as CLEP, lifelong 21 learning, etc., including all related costs and revenues thereof 22 shall be excluded from the function of "Instruction" and 23 included under "Public Service." 24 Section 11. In addition to the requirements of section 7, 25 Pennsylvania State University shall, by March 1, 1985, submit to 26 the Appropriations and Education Committees of the Senate and 27 the House of Representatives a breakdown of the funds budgeted 28 for this fiscal year for the main campus and each branch campus 29 including expenditures budgeted from this act and expenditures 30 budgeted from moneys other than those appropriated by this act. 19840H2052B2785 - 7 -
